EXCLUSIVE: Lindsay Lohan Could Be Sentenced Up To One Year In Jail

Judge Elden Fox could sentence Lindsay Lohan up to one year behind bars when she appears for her probation violation hearing on Friday, RadarOnline.com has learned exclusively .

A source close to the actress, 24, told RadarOnline.com: “Judge Fox could be inclined to sentence Lindsay on Friday up to one year in jail. The fact that he ordered Lindsay to appear, even though she is currently in rehab and not planning to fight the probation violation, has Lindsay’s legal team very, very, concerned.”

The insider continued, “Even though Judge Fox has previously said that any dirty drug test would result in an automatic 30 days behind bars, he could go above and beyond that and simply terminate her probation. If he does that, he can sentence Lindsay to up to one year in jail. She would get credit for time served from her stint at Lynwood earlier this year and would probably do four to five months in jail.”

As RadarOnline.com reported, Lindsay failed a drug test just 3 weeks after her release from UCLA Medical Center in August. She appeared in court and was immediately remanded to custody at Lynwood Correctional Facility. Her lawyer filed an appeal, however, and she was released after several hours. Lindsay then voluntarily checked into the Betty Ford Center in Rancho Mirage, Calif. where she’s been receiving treatment.

A source close to Lindsay’s camp told RadarOnline.com, “I wouldn’t be surprised if she gets a year in jail and serves six months. I think everyone close to her would like to see her go back to rehab, but there’s an overwhelming feeling that something is going to happen to Lindsay if she doesn’t go away for a long time, so they’re reconciling with the fact that she could go to jail for a while. People are scared.”

As RadarOnline.com reported exclusively on Wednesday, Judge Fox has refused to meet with Lindsay’s lawyer and the DA before Friday’s hearing.

“Judge Fox is fair, but if there is an inclination that someone has violated his orders, he doesn’t have any patience for that,” the source told RadarOnline.com.

If they had made her complete her full 90 days in jail and then the full 90 days in inpatient rehab this last time, she may not have relapsed. This is one time I will actually say that sending her back to jail would be BS.

She was never getting the full 90 days in jail the Judge wanted to make her serve as close to 30 as possible. She wouldn't have lasted 90 days in court ordered rehab.

Why do you say she wouldn’t have lasted 90 days in court ordered rehab? What's the difference?
Don’t you agree she needs a longer program than she’s done in the past?
It’s not like she was in some lock down skid row drug rehab.

If she's couldnt do 90 days at UCLA, then how commited could she at Better Ford?

She is commited to avoiding jail. She has already done 23 days there so even if it becomes court ordered next week she can move to Betty Ford's sober living facility and get her blackberry & unrestricted smoking back.

LL supporters like to use Robert Downey Jr. as an example... RD Jr was on 3 years probation when he missed a drug test and served 3 months in jail. Then while on probation again, missed a test and served 1 year in jail.

Thanks for bringing that up. All these people like to use RDJ as an example of how Lindsay can straighten her life out yet at the same time these "fans" do not want her to spend the time in jail that RDJ had to spend inorder to get his act straight.

as an aside... the second sentence was actually for 3 years, but he was let out early for time served, and good behavior.

RDJ is an Academy Award winning A list star, and the cameras were on him throughout his entire court process. Handcuffs and all.
Lindsay did a couple of kid movies 10 years ago and has the cameras turned off when shes handcuffed
