In the lawsuit they repeat the allegations that they made in their restraining order application - that on December 19th Marlowe tried to film Simmons at The Grove shopping mall in LA. He says he asked Simmons about “his public persona about monogomy” and that Simmons then grabbed him by the throat, head butted him, choked him and said “I will kill you”. Marlowe says Simmons then grabbed his wife by the throat and said to her, “I will kill you” before making off with Marlowe's camera.
