While RadarOnline.com has obtained the $5 million countersuit Jon Gosselin is set to file against TLC, the father of eight stayed mum on the subject on a recent outing near his New York City apartment.

“I can’t say,” Gosselin mumbled to photographers when asked whether he was filing suit against the network. He also kept quiet about any potential holiday plans with Hailey Glassman.

The papers obtained by RadarOnline.com regarding Jon’s response to TLC’s breach of contract lawsuit and request for a preliminary injunction reveal Gosselin was earning $22,000 per half hour episode of Jon & Kate Plus 8 and $45,000 per hour-long episode according to an April 29, 2008 contract.
