L.A. City Attorney Rocky Delgadillo wants Paris Hilton's freedom revoked—now. He says the decision by the L.A. County Sheriff's office to release Hilton at 2 a.m. Thursday morning after serving just three of her 23 day jail term amounts to contempt of court. The heiress sports a Tracy Morgan-style ankle bracelet that monitors her whereabouts and drinking, but Delgadillo, known as a crusader for tougher treatment of celebrity screwups, says that specifically violates judge Michael T. Sauer's orders that "no electronic monitoring" be used in lieu of jail time.

"Paris Hilton should be treated the same as everyone else," a flabbergasted Delgadillo told Radar late yesterday. "No one is above the law."

He says the decision to let Paris out was solely that of the sheriff's office and adds that a motion and a proper hearing should have taken place before any decision for release was made. "If I had been consulted, I wouldn't have done it," he tells Radar. And the alleged "medical emergency" behind the sudden release? "She was crying a lot ... she was depressed," the medical provider tells the New York Post today. "There is a top medical facility there [at the L.A. County jail]," Delgadillo says.

Hilton is also being credited with serving five days, counting Sunday night and Thursday morning, although her real time amounts to more like three days.

"On any give day, a thousand female inmates are in custody. Why is one case, out of the blue, treated any different than them?" Steve Remige, president of the Association of Los Angeles Deputy Sheriffs, tells the Post. L.A. County Supervisor Mike Antonovich adds, "You're dealing with a spoiled brat acting out to get her way instead of serving her time as was adjudicated by the courts."

Delgadillo demanded and will receive a hearing before judge Sauer at noon EST today. He plans to ask that Hilton be sent back to the grey bar hotel.

"Her release sends the wrong message," he says.
