The 36-year-old singer gave birth to her second son Zayne on April 9, RadarOnline.com has learned. Zanye's dad is music producer David Wilson, McCready's beau of two years.

While McCready originally claimed she was expecting twins, her rep said the mistake was the result of a "misinterpreted sonogram [that] seemed to support her feelings and excitement."

Mindy McCready, in her first interview since her son Zander was taken from her by U.S. Marshals after she left Florida with him -- told ABC News the 5-year-old boy was inconsolable when they were separated, and that the reason she took him was "to protect" him.

“What I did was to protect my child,” she said, “and there's not a person in the world who will tell me I am wrong."

The country singer, 36, said when authorities found she and her son at her boyfriend David Wilson's Arkansas lake house Friday, the boy began screaming and crying for his mother.

Troubled country singer Mindy McCready will face a judge in Arkansas on Monday after she disappeared with her five year-old son last week.

Mindy, whose mother Gayle Inge has custody of her son Zander, was found hiding in a closet with the boy following a multi-state search for the pair after she left Florida with him.

Mindy – who just announced she’s pregnant with twins – says she was “emotional” when found by police Friday night hiding in the Arkansas lake house owned by her current boyfriend David Wilson, but there was not a struggle, according to ABC News.

Law enforcement has been searching for the pair for three days after Mindy, who only has supervised visitation with Zander, took him and fled Florida where he lives with McCready's mother, Gayle Inge. Inge has been Zander's legal guardian since 2007.

The troubled country singer, who has had very public battles with drugs, was found hiding in a closet with Zander at her boyfriend's Heber Springs, Arkansas home.

Florida Department of Children and Families spokeswoman Terri Durdaller said Friday night that her agency was working with Arkansas state officials to bring Zander back to his grandmother in Florida.

McCready has not been charged with any crime.

McCready, 36, does not have custody of her son and some reports are saying she’s “kidnapped” him after taking the boy from his father’s house for a visitation.

Both the Cape Coral Police Department and the Department of Children and Families have been notified of the missing persons report that was filed on Tuesday night.

Attorney James Moon claims that the reunification process that could ultimately allow Mindy custody of her son Zander (who is currently in the care of Mindy’s mother Gayle McCready Inge) has been halted because the Florida Department of Children and Families hasn’t received her medical records -- which it can freely retrieve on its own.

“The state keeps making all this stink about ‘we want these records, we want that’ and telling us we never complied…and Mindy signed a bunch of medical releases when her rights were taken away so the State could have gotten records all along,” Moon told RadarOnline.com exclusively.

In his motion filed Thursday, Moon writes that at the last hearing on July 7 the court gave “additional directives to the State…to prevent any further confusion on what was to be expected of each participant in this matter,” but no court order has been filed, leaving his case at a “standstill.”

“I want them to go out and do their job and get Mindy’s records. They have the ability to get Mindy’s records. They have HIPAA releases that she (Mindy) signed before, and they don’t need HIPAA releases because the court made a determination that Mindy’s rights of privacy are outweighed by the state’s need to have medical records. So they can go out and get these any time they want and they have made no attempt whatsoever.”

The reunification process was provisionally re-opened back in May, and Moon believes the state’s delay only makes Mindy look bad in the eyes of the court.

“The matter will remain at a virtual standstill until…the State elects to collect records of treatment…and gives this court the appearance that the natural mother is intentionally not complying,” he wrote in the filed paperwork.

Moon said he disclosed Mindy’s medical records, those of which he has access to, but has not been informed by the state if those are satisfactory.

“If I went out and got the medical records and handed it to them and all they’d have to say is ‘judge, there’s nothing to indicate these are all the records.’ They can just keep objecting that they’re incomplete. The only choice we have is they get the medical records.

“We’re in a situation where we can never get Zander back because we’ll never be able to comply.”

Moon said Mindy has been in full compliance with her drug and alcohol testing and continues to have supervised visits with her son.

“I plan on going in there, scream bloody murder and ask, ‘help me out, court. Judge help us out, we’re doing everything we can, we’re taking the urine screens, we’re trying to comply but we’re at a point where we can’t comply so help us out,” Moon said. “Either force their hand or give us the kid back because they’re never going to do what you’ve told them to do, which has been our complaint all along -- that they’ve been biased against her.”

Mindy’s attorney James Moon filed an emergency motion for temporary unsupervised visitation with her 4-year-old son Zander for the next few days to attend the funeral of Mindy’s grandmother who was recently killed in a car accident.

“The natural mother would like the ability to have her son attend the grandmother’s funeral, however to do so, would require either unsupervised visitation and/or a change in the custodial arrangement for a limited duration of at most five (5) days,” the motion states.

According to the documents, Mindy, who currently has supervised visits, fears that there “may be miscommunication” between family members and she may not be able to see her son at all.

Over the last few months, Mindy and her mother, who has custody of Zander, haven’t quite seen eye-to-eye, having aired their dirty laundry in public.

Judge James Seals denied her request in an email which said, “Requests for added visits is not an emergency.  Try to work it out.  Court can’t intervene.”

Mindy McCready is in a custody battle to get her son Zander back from her mother and recently posted an open letter rallying her fans for help.

In a rambling July 1 post on her MySpace page, McCready takes aim at her mother Gayle McCready-Inge, her ex (and Zander’s father) Billy McKnight, and the city of Ft. Myers, Florida, where the case is being handled.

“I need you to write letters, make phone calls, send emails, do anything you believe will help save my son from the Hell they have put him in!! Please take 10 minutes out of your day and do something, do anything,” she implored.

“I know that my Mother is pure evil!” Mindy writes at one point, alleging her mother is trying to broker her role in Mindy’s ongoing drama into a book deal with Oprah. Mindy also says Gayle is taking Zander on trips to spread the word of God and is telling people that Mindy’s thirteen-year old brother can heal the sick. “They are taking my son all over the place with them, traveling from church to church, telling people that my 13 year old brother is able to heal the sick, while collecting thousands of dollars from all these hard working people... I saw a video tape of my son in the congregation of one of these churches and he was terrified!! People were screaming in tongue's, running all over the place dancing like they were possessed and fainting everywhere.”

She also claims that McKnight is seeking custody of Zander for publicity reasons since he is “still trying to have a singing career after over two decades of absolutely no success what so ever.” She also chronicles his alleged history of violence and drug abuse.

Gayle allowed Mindy to stay in her Ft. Myers home for a week in May despite the steady stream of allegations Mindy has thrown her way since their custody dispute began. “I’ve allowed Mindy to come here and stay... this after she has bad mouthed me... so she can see her child,” Gayle told RadarOnline.com shortly after Mindy was rushed to the hospital on May 25.

James Cartright Jr., a cousin of Mindy’s, penned a letter after Mindy’s hospitalization. In it, he defended Gayle and called Mindy’s accusations lies. “Mindy has repeatedly made claims against her mother which are either inaccurate or untrue,” Cartright wrote in the letter. “Mindy says she is ready to commit to being Zander's mother and that her previous troubles are over. Her entire family wishes that were true. Mindy is a very charming person. She can be funny and at times she can even be giving of herself. She is a beautiful and talented woman who continues to be haunted by her own denial.”
