Dr. Conrad Murray is asking a judge to throw out the wrongful death lawsuit that Michael Jackson's father, Joe filed against the King of Pop's one time physician, Radaronline.com can exclusively report.

Lawyers for Dr. Murray filed the legal docs last Friday, arguing that Joe Jackson doesn't have legal standing to even file the lawsuit -- Michael left his father, Joe out of his will and did not support him financially.

The legal docs state: "Joe Jackson further has no standing to sue pursuant to...in that he was not dependent upon the decedent for support and therefore Joe Jackson has no subject matter jurisdiction, alternatively, in personam jurisdiction to sue....Defendants request that the Plaintiff's case be dismissed, alternatively, that the Plaintiff go forth without recovery from these Defendants."

The family of a two-year-old boy who plunged to his death during a Los Angeles Lakers basketball game is suing the owners of the Staples Center where the star-studded team plays, RadarOnline.com has learned.

The lawsuit filed on Tuesday at the Los Angeles Superior Court claims that Anschutz Entertainment Group (AEG) and L.A. Arena Co. failed to warn fans of the dangerous design of the luxury suites in the downtown L.A. stadium. The filing alleges wrongful death and negligence and the family is seeking unspecified damages, along with an injunction demanding taller barriers in the sky boxes at the sports center.

Ortega, the famed choreographer and director who was helming Michael Jackson's planned This Is It concert series, was named by Katherine Jackson as one of the people she believes is responsible for her son's death.

Nothing could be further from the truth, Ortega says and on January 26, he filed a Memorandum of Points and Authorities stating he was "wrongfully and mistakenly named as a defendant in this case."

Ortega, the document states "has been extremely hurt by this mistaken and misguided Complaint publicly naming him as a defendant allegedly responsible for his friend's death."

He's asking the court to remove him as a defendant in Katherine's ongoing lawsuit against the giant entertainment and sports presentation company, AEG.

Dr. Conrad Murray’s attorney appeared in a Los Angeles courtroom Wednesday afternoon to appeal to the LA County Coroner to perform tests on forensic evidence in the criminal case surrounding Michael Jackson’s death – but refused to recognize the coroner’s declaration at the judge’s request, RadarOnline.com has learned.

Dr. Conrad Murray’s attorney appeared in a Los Angeles courtroom Wednesday afternoon to appeal to the LA County Coroner to perform tests on forensic evidence in the criminal case surrounding Michael Jackson’s death – but refused to recognize the coroner’s declaration at the judge’s request, RadarOnline.com has learned.

District Attorney Dave Walgren countered, asking the defense to acknowledge that the Coroner might destroy the evidence in question during the testing.

"I'm not going to litigate the facts. The defense seems to be operating under the guise that Michael Jackson killed himself,” Walgren said Wednesday during the court hearing.

“They won't come out and say that, but that is where they are headed."

Walgren didn’t object to testing, he just asked that it be done correctly and that a chain of custody be placed for the evidence.

Judge Pastor told Murray’s attorney, Michael Flanagan, any order he would sign off on must include that the defense acknowledges certain elements of the coroner's declaration.

Flanagan was not ready to make that concession yet.

As RadarOnline.com previously reported, Murray’s attorneys say the fluid testing is urgent before the evidence deteriorates. Prosecutors are asking the doctor’s attorneys be given only half the residue in the syringes and will only agree to the testing if it’s done correctly.

Murray plead not guilty to involuntary manslaughter for allegedly injecting Jackson with drugs the night he died.

Despite media reports that there would be 20 witnesses called for the preliminary hearing, the DA said it would be approximately 35 witnesses.

Murray did not appear in court Wednesday for the hearing.

A wrongful death lawsuit filed against Dr. Conrad Murray by the father of pop icon Michael Jackson will be moving to state court after a federal judge said Monday he didn’t have the authority to hear the case.

According to the Associated Press, U.S. District Judge John F. Walter told Joe Jackson’s attorney, Brian Oxman, during a hearing that he didn't think Jackson's father could receive any money from one of the major causes of action, which alleged the singer's rights were violated under the Americans with Disabilities Act.

Oxman agreed to dismiss part of his case against the doctor charged in Jackson’s death, which prompted the judge to rule that the remaining issues had to be heard in state court.

And the 57-year-old doc believes their testimony could help get him off a charge of involuntary manslaughter for giving Jacko a lethal sedative overdose.

RadarOnline.com has learned Jacko's kids, Paris and Prince, will be called as a defense witnesses over the death of their dad and will be questioned about specific statements supposedly made not soon after his death.

Dr. Murray, who has been charged with involuntary manslaughter, believes Prince, 13, and Paris, 12, will admit their father had long-standing drug addictions.

The source said: "After saying goodbye to her dad at the hospital, Paris said, 'My daddy is so cold again. He was always cold. He would sit by the fire to get warm. We were always afraid he would fall in as we was so close to the flames. He couldn't get warm. Now there he is... so cold."

The tearful comments were made in front of a group of people, RadarOnline.com has learned.

"Prince and Paris knew their dad relied on Dr. Murray to survive and knew their father adored him," said a source, familiar with the legal case.

"Their comments, if they back him, could save him from jail because it would work well in the eyes of a jury."

Murray, a cardiologist who was with Jackson when he died June 25, 2009, at his rented Los Angeles mansion, is accused of acting "unlawfully and without malice" in bringing about Jackson's death, according to a complaint filed by prosecutors.

The complaint said Murray acted "without the caution and circumspection required" when he administered a powerful sedative to Jackson in an effort to help him sleep.

Murray, who has pleaded not guilty, is due to stand trial next year.

If convicted, he faces as much as four years in prison.

The lawyer for Murray, Ed Chernoff, told RadarOnline.com: "No decision has been made as to what witnesses will be called and the last possible witnesses we would want to call would be the children."

Dr. Conrad Murray, the cardiologist charged with involuntary manslaughter in connection with Michael Jackson's death, and who is being sued for wrongful death by Joe Jackson, has just filed legal documents stating Joe has no legal standing to sue.

The attorneys for Dr. Murray claim in the document, "Joseph Jackson was not a dependent of Michael Jackson. He was not named in Michael Jackson's will.

Neither in life nor in death did Michael Jackson make any provision for the dependency of his adult father Joseph Jackson...Joseph Jackson applied for and was refused maintenance by the Estate of Michael Jackson because he could not show himself a dependent or that it was Michael Jackson's intent that he be treated as a dependent or heir."

Dr. Murray's legal team states, "the defendants do not merely challenge the pleading, but deny the underlying allegations that Plaintiff was in any way a dependent of the decedent, Michael Jackson, such that he would have standing in the instant matter."

Joe Jackson's civil lawsuit against Dr. Conrad Murray over the death of pop icon Michael Jackson can now move forward, RadarOnline.com has exclusively learned.

United States District Judge John F. Walter gave the Jackson patriarch the go-ahead to proceed with the case now that the proper paperwork has been submitted.

On August 4, 2010, Judge Walter requested that Jackson prove that the United States District Court, Central District of California had jurisdiction in the case because in Jackson’s original complaint, he failed to “allege the defendant’s principal place of business.”

Weeks later, Jackson's attorney Brian Oxman drafted and provided Judge Walker with a first amended complaint in response to the inquiry.

Today, Judge Walker ruled he was satisfied with the paperwork and is allowing the lawsuit to proceed.

Joe Jackson's civil lawsuit targets Dr. Murray as well as his businesses, Acres Home Heart & Vascular Institute and GCA Holdings, LLC for the wrongful death of Michael Jackson.

Jackson is seeking unspecified damages.

Prince Michael Malachi Jet Jackson, the 25-year-old man who came forward last year claiming to be Michael Jackson’s secret son, is planning to join the Jackson family’s wrongful death lawsuit, his attorney exclusively tells RadarOnline.com.

“Michael Jackson’s father, Joe, is not aware that he will be joining the suit,” lawyer LaRue Grim revealed.
