Jury Awards Man Assaulted By Kid Rock $40,000

A man claiming he was assaulted by musician Kid Rock and his entourage while dining at a Waffle House restaurant in Georgia was awarded $40,000 on Friday, RadarOnline.com has learned.

Harlen Akins filed a lawsuit against Rock – whose real name is Robert James Richie – and five of his friends after a fight broke out between them in 2007, leaving Akins with costly medical bills.

Rock testified in an Atlanta-area courthouse on Thursday that he never laid a hand on Akins, but instead fought with him using words.

“I gave it to him verbally. I said, ‘Shut your mouth, man,’” Rock said.

Musician Kid Rock took the stand Thursday morning in a Georgia courthouse to testify about a 2007 fight he was involved in with alleged victim Harlen Akins at a Waffle House restaurant.

Musician Kid Rock took the stand Thursday morning in a Georgia courthouse to testify about a 2007 fight he was involved in with alleged victim Harlen Akins at a Waffle House restaurant.

Kid admitted that heated words were exchanged with Akins but that it was Akins who goaded him and his entourage into a physical confrontation.

The musician denied ever laying a hand on him.

“I gave it to him verbally. I said, ‘Shut your mouth, man,’” Kid said, who was born Robert James Ritchie.

However, Kid testified that members of his entourage who were at the restaurant did hit Akins, but only used as much force as necessary and did so in self-defense.

"If you look at me, Bossy, Jason and Bear," he said referring to members of his entourage who are all big men, "if we wanted to hurt this man, we could have hurt him very, very bad."

Kid also had to explain why he got into a fight with fellow rocker Tommy Lee at the MTV Video Music Awards back in 2007.

The musician told the judge that he and Lee had “bad blood” over their relationships with Pam Anderson and had exchanged “smack talk” text messages prior to the VMA’s.

The two rockers somehow ended up next to each other during the award show.

"He smacked my hat off" Kid testified, so he “popped” Lee in the face.

Kid said that after the incident, Lee called him and apologized and the two rockers are now friends.

Sex Tape Celebs

Earlier this week, several professionals also took the stand including several doctors who testified that Akins had injuries consistent with having been in a fight.

And firefighter, who drove Akins to the hospital, said that he didn't note anything in his report about the alleged victim being bloody and found no signs of internal bleeding.

In 2008, Kid pleaded no contest to a misdemeanor charge of simple battery stemming from the incident and was sentenced to one year probation, anger management counseling and community service.

Kid Rock was present in court Tuesday where a Waffle House waitress testified that she saw him 'swing and hit' another customer at the Georgia restaurant which resulted in the rocker's arrest.

Melissa Burkes told the court during trial in a civil lawsuit against Kid Rock that she saw the star's entourage 'push Harlen Akins out the door' before brawling with him in the parking lot of the Buford Highway restaurant.

Harlen Akins is suing the rocker claiming he was beaten by Ritchie's entourage and seeks to have a $6,000 medical bill covered plus "a small amount" for pain and suffering, according to his attorney.

Kid Rock is contesting that he did not cause the fight that happened on October 21, 2007 and that he repeatedly tried to diffuse the situation.

William Horton, attorney for the rocker says, "There's a pattern of provocation and escalation from the plaintiff," Horton argued in his opening statement. "The plaintiff picked the fight."

But testimony by eyewitness Burkes paints a different picture.

"[Akins] was on the ground and they were still fighting him," Burkes testified.

She said Akins, 41, was not fighting back.

Burkes testimony supported a claim by Akins lawyer, Eric Hertz that Kid Rock started the brawl.

"Go out there and kick his [butt]," said Hertz, quoting defendant Ritchie.

The attorney added: "Someone insults [Kid Rock] and he beats them up."

Ritchie was arrested after the brawl and sentenced to 12 months probation and anger-management counseling.

The 2007 fight broke-out after Akins got in an argument with one of Kid Rock's friends and the rocker told him to 'Shut the f*** up'.

A video camera inside the Waffle House captured what happened.

On the video, members of Kid Rock's entourage can be seen striking and stomping on the plaintiff, smashing his cell phone and a Waffle House window.

But Kid Rock claims he acted in self-defense when he picked up a chair and tossed it through the window of the all-night diner.

He said Akins repeatedly harassed the women at his table, eventually telling the defendants, "I am going to call my boys and have them shoot the place up."

After punches were thrown, Jason Krause, one of Ritchie's co-defendants, destroyed Akins' phone to prevent him from calling his friends, the defense argues.

Akins then "purposely punched his fist through a large plate glass window in an attempt to attack" Kid Rock, the star's attorney claims.

Kid Rock's lawyer contests that Akins injuries were 'self inflicted' and that that the civil suit is only being brought because his client is famous.

The court case in Dekalb County continues this week.
