Outrage Over Charlie Sheen's No-Jail Sentence

Just hours after actor Charlie Sheen struck a plea deal regarding his domestic violence case in an Aspen, Colorado courtroom on Monday, the female police officer embroiled in the case spoke out about her outrage over the light sentence that is sending him to rehab – not jail.

Valerie McFarlane – the cop who resigned under pressure following Sheen’s Christmas Day arrest – made an official statement with the support of her attorney, legal powerhouse Gloria Allred.

Just hours after actor Charlie Sheen struck a plea deal regarding his domestic violence case in an Aspen, Colorado courtroom on Monday, the female police officer embroiled in the case spoke out about her outrage over the light sentence that is sending him to rehab – not jail.

Sheen Defense Will Discredit Cop To Beat Domestic Violence Charge

Valerie McFarlane – the cop who resigned under pressure following Sheen’s Christmas Day arrest – made an official statement with the support of her attorney, legal powerhouse Gloria Allred.

“I am appalled that the Court has chosen to impose the lightest possible sentence imaginable on Mr. Sheen,” said McFarlane. “I wish that the judge could have seen what Mrs. Sheen looked like that Christmas Day and felt the terror that I believe she must have experienced as a result of what she alleged had suffered because of Mr. Sheen’s conduct towards her.”

Charlie Sheen Pleads Guilty To Misdemeanor Assualt, Ordered To Go To Rehab

The Two And A Half Men star pled guilty to misdemeanor assault and was ordered to spend 30 days in a Malibu rehabilitation center, RadarOnline.com reported. The other charges - felony menacing and a criminal mischief misdemeanor - were dismissed.

In support of her passionate feelings, McFarlane gave details on the scene that she found when she arrived at the Sheen’s house after the assault.

“I observed a red mark on the upper part of her neck which appeared to be as a result of a strangulation hold and red marks on her arms. I also saw older bruises that appeared to be in the healing process,” she explained. “A knife was recovered at the scene which Brooke alleged had been used by the defendant to threaten her.  Brooke was crying uncontrollably as she described the incident to me.”

McFarlane went on say that she believes, “that this type of the sentence sends a message to victims that they are not important or worthy and that the court will not protect them by making sure that serious consequences are imposed on the perpetrators of the crimes against them.”

The former police officer added that she hopes that it won’t deter other victims from coming forward. “Victims do not have to live and operate from a place of fear, feel hopeless or suffer in silence.”

Besides checking into Promises Treatment Center in Malibu, Sheen has to do 36 hours of anger management and must pay the court costs and fees incurred. He can begin his 30-day stint at Promises in 30 days time and will be on probation for three months.

In Aspen, Colorado, representing MacFarlane, Gloria Allred also vehemently spoke out against Monday’s ruling.

“Today the court imposed what I believe to be an extremely laughable and unacceptable light sentence on Mr. Sheen for his criminal misconduct in this case,” said Allred. “Mr. Sheen was originally charged with a felony in this case. If convicted he could have been sentenced to substantial time in prison. In his sentence today he was given the biggest break that he has ever had. The only thing missing from his sentence is the red carpet as he goes on probation with adoring fans and applause.

Calling it a “sweetheart deal,” Allred said the sentence reinforced the opinion that there are two levels of justice – one for the rich and famous, and another for regular people.

“The drama on Christmas Day in the Sheen home was not a fictional Hollywood movie,” said Allred. “It was a serious real life dangerous situation and should carry serious real life consequences for the perpetrator of the dangerous criminal assault that took place, rather than the extremely light sentence that he received today.

“At this point we can only hope and pray that we will not all be back here next year at this court or another court with another victim of Charlie Sheen.”

Valerie McFarlane was fired from the police department for a series of incidents, which included allegedly attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy.

She also reportedly gained VIP access and snuck her daughter and her daughter’s boyfriend into the VIP area.

Valerie McFarlane, the disgraced former cop in the middle of the Charlie Sheen domestic assault investigation, is embroiled in a child custody case, RadarOnline.com can exclusively reveal.

Valerie McFarlane, the disgraced former cop in the middle of the Charlie Sheen domestic assault investigation, is embroiled in a child custody case, RadarOnline.com can exclusively reveal.

McFarlane, who handled Brooke Mueller's interview following her altercation with husband Charlie Sheen, says she was "forced to resign" from the Aspen PD following a series of incidents where her behavior was called into question. She has two teenage daughters with Alex Bracero, who tells RadarOnline.com that he believes his ex-girlfriend is in violation of their custody agreement and he's headed back into court.

"I want her to follow the rules. I want to see my kids," Bracero tells us.

Bracero and McFarlane lived together in Florida before they split four years ago. They originally were able to work out custody but things got sticky when McFarlane moved to Colorado.

"She moved there for the job with the police department which she said was really important to her," Alex explained. According to Alex, he "agreed to let her have full custody but she was required to send the girls back to me in Florida every summer. They are supposed to be with me from the first weekend following their last day of school to the last weekend before school starts up again in September.

"She's found all sort of excuses not to send them this summer, and it's not right. She managed to lose her job but she's still living beyond her means and she claims she can't afford to send the girls to me."

Since his split from McFarlane, Bracero has married and fathered two children. He's a service tech with a TV cable company, who supports his family and pays $600 a month in child support to McFarlane for their daughters Adriana, 14 and Jordan, 13.

As RadarOnline.com exclusively reported, McFarlane is now working for a supermarket outside of Aspen where part of her training includes bagging groceries.

Bracero claims that his ex is "living in a $3,000 a-month rental and has $300 a-month car payments," and that  "she had a motorcycle too but that was repossessed. She's always lived big which was one of the things that brought about our break-up."

A few weeks ago, McFarlane informed Bracero by email that she wouldn't be sending him the girls for the summer. She claimed that after being "forced to resign" from her job, she was not able to get unemployment and she had no income. But Bracero claims their court agreement mandates she send him the kids for the summer at her expense.

"I've been trying to get the money together to get her back into court," Bracero says. "It's complicated and expensive because there are two states involved.

"There are a lot of men out there who don't care about their kids. I do. I've always paid my child support and I want to be in my daughters' lives.

"She let her involvement in the Sheen case go to her head and she messed up her job."

Valerie McFarlane resigned  from the Colorado Police Department following a series of incidents and Sheen’s legal team planned to attack her credibility in any future trial.

McFarlane is now working as a customer relations manager at the City Market in El Jebel outside Aspen. As part of her training she has been learning everyone else’s position --and even bagging groceries.

A worker at the store told RadarOnline.com: “Yes, she does work here.”

McFarlane resigned from the police department and has been mired in controversy. She was accused of attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty, which would be a direct violation of department policy.

She also was accused of  gaining VIP access and sneaking her daughter and her daughter’s boyfriend into the VIP area.

Meanwhile, the other officer who responded to Mueller’s Christmas 911 call, Rick Magnuson, made headlines after a video was released of him simulating masturbating in the Mojave Desert – and now he’s, running for sheriff of the Colorado Police Department, RadarOnline.com has learned.

See Bizarre Video Of Officer Magnuson In Action:

The controversial cop, who interviewed Sheen following the alleged assault, lost an election bid for sheriff four years ago when he was defeated by presiding Sheriff Bob Braudis.

Although he ran on a tough anti-drug ticket, when he was questioned during a live television debate in 2006 Magnuson boasted that he used illegal drugs while employed in law enforcement – adding that he used them only once while in Amsterdam where they are legal.

EXCLUSIVE: Sheen Defense Will Discredit Cop To Beat Domestic Violence Charge

Charlie Sheen will fight for his freedom beginning Monday when he faces three domestic violence charges stemming from an incident with Brooke Mueller and RadarOnline.com has learned that his defense will attack the credibility of the police officer who interviewed Mueller at the scene.

RadarOnline.com has also learned that there are no independent witnesses to whatever happened between Brooke and Charlie, complicating the prosecution’s efforts to convict the Two and a Half Men star.

A source close to the situation told RadarOnline.com that Assistant District Attorney Arnold Mordkin and his team will heavily rely on Mueller’s emotional 911 call where she claimed Sheen had a knife, threatened her and that she was scared for her life.

The Two And A Half Men star’s legal team, meanwhile, will claim that no offense happened and are gearing up to attack the credibility of local Patrol Officer Valerie McFarlane who has just been fired from the Colorado Police Department.

McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas.

She was the officer that interviewed Mueller about the incident while the other arresting officer, Rick Magnuson, who interviewed Sheen, also has a murky past. Mueller told McFarlane that Sheen held a knife to her throat and threatened to kill her.

EXCLUSIVE: Charlie Sheen’s Defense: It Never Happened

McFarlane was fired from the police department for a series of incidents, which included allegedly attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy.

She also reportedly gained VIP access and snuck her daughter and her daughter’s boyfriend into the VIP area.

A source told RadarOnline.com: “It’s going to be very interesting because there does not seem to be any plea deal on the horizon and both sides believe they have strong arguments to make.

PHOTOS: Charlie Sheen Through The Years

“Mordkin does not believe that the defense bringing-up McFarlane’s credibility is as strong as Mueller’s actual 911 call.

“It should make for an explosive situation and the stakes have never been higher for Charlie Sheen at this stage in his career.”

Sheen is facing one felony and two misdemeanor charges in connection with the domestic violence incident - since the Christmas arrest he has entered rehab and so has his wife Brooke Mueller.

RadarOnline.com has also learned there are no witnesses to the incident between Charlie and Brooke, a good situation for the defense.

As RadarOnline.com reported earlier, Sheen’s legal team will actually try to discredit his wife’s recollection of events to the police because of her alcohol and drug problems. She had been drinking heavily and doing drugs in the hours before calling 911.

“Charlie is going to contend that everything Brooke told police isn’t true – that she was out of her head, that she was so messed up she didn’t know what was going on,” one source said.

The other thing Sheen has going for him is Mueller does not want to cooperate with prosecutors. And while she has to be careful about backing off her story because she could be prosecuted for making false statements to police, she also does not have to cooperate with prosecutors.

Colorado has cracked down on domestic violence cases and won convictions without the testimony of the beaten spouse but this case is more difficult for prosecutors because Mueller’s heavy drug and alcohol usage at the time of the incident will harm her credibility.

EXCLUSIVE: Cop In Charlie Sheen Criminal Case Fired

The prosecution has been busy building their case against Charlie Sheen over his Christmas Day incident with wife Brooke Mueller, but it seems they may have hit a slight bump in the road. RadarOnline.com has learned that key witness Patrol Officer Valerie McFarlane was just fired from the Aspen Police Department.

McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas and told police Sheen had held a knife to her throat and threatened to kill her. McFarlane was the officer that interviewed Mueller about the incident while the other officer, Rick Magnuson, interviewed Sheen.

“She is no longer working with the department,” an Administrative Supervisor for the Aspen Police Department told RadarOnline.com. “Her last day was last week.”  An inside source told RadarOnline.com that McFarlane “was fired for a "series of episodes'", which includes attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy. The source says McFarlane also gained VIP access and “snuck her daughter and her daughter’s boyfriend into the VIP area.”

McFarlane's credibility has clearly taken a hit, which could be great news for Sheen’s defense team. However, a source tells RadarOnline.com that Chief Deputy District Attorney Arnold Mordkin “is not overly concerned about the impact of her firing on the case” because he’s sure “the 911 tape, in which we hear Brooke’s allegations and fear, takes care of the problem.”

McFarlane has had her fair share of domestic issues. In 2006, she petitioned for permanent custody of her daughter from the child’s father Alex Bracero, which she won in 2009 after almost three years of nasty court battles. In 2008, she was accused of grand theft auto, fraud and forgery in the state of Florida but formal charges were eventually dropped by the State’s Attorney’s Office. That same year, McFarlane was granted a permanent restraining order from ex-boyfriend Brian Deason after citing domestic abuse.
