But the laughably lenient sentence that sends Sheen to rehab instead of jail is not unusual, according to domestic violence experts.

Valerie McFarlane – the cop who resigned under pressure following Sheen’s Christmas Day arrest – made an official statement with the support of her attorney, legal powerhouse Gloria Allred.

The cop who interviewed Brooke Mueller after Charlie Sheen allegedly held a knife to her throat is now working in a grocery store, RadarOnline.com has learned exclusively.

EXCLUSIVE: Sheen Defense Will Discredit Cop To Beat Domestic Violence Charge

Charlie Sheen will fight for his freedom beginning Monday when he faces three domestic violence charges stemming from an incident with Brooke Mueller and RadarOnline.com has learned that his defense will attack the credibility of the police officer who interviewed Mueller at the scene.
RadarOnline.com has also learned that there are no independent witnesses to whatever happened between Brooke and Charlie, complicating the prosecution’s efforts to convict the Two and a Half Men star.
A source close to the situation told RadarOnline.com that Assistant District Attorney Arnold Mordkin and his team will heavily rely on Mueller’s emotional 911 call where she claimed Sheen had a knife, threatened her and that she was scared for her life.

The Two And A Half Men star’s legal team, meanwhile, will claim that no offense happened and are gearing up to attack the credibility of local Patrol Officer Valerie McFarlane who has just been fired from the Colorado Police Department.
McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas.
She was the officer that interviewed Mueller about the incident while the other arresting officer, Rick Magnuson, who interviewed Sheen, also has a murky past. Mueller told McFarlane that Sheen held a knife to her throat and threatened to kill her.
EXCLUSIVE: Charlie Sheen’s Defense: It Never Happened
McFarlane was fired from the police department for a series of incidents, which included allegedly attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy.
She also reportedly gained VIP access and snuck her daughter and her daughter’s boyfriend into the VIP area.
A source told RadarOnline.com: “It’s going to be very interesting because there does not seem to be any plea deal on the horizon and both sides believe they have strong arguments to make.

“Mordkin does not believe that the defense bringing-up McFarlane’s credibility is as strong as Mueller’s actual 911 call.
“It should make for an explosive situation and the stakes have never been higher for Charlie Sheen at this stage in his career.”
Sheen is facing one felony and two misdemeanor charges in connection with the domestic violence incident - since the Christmas arrest he has entered rehab and so has his wife Brooke Mueller.

RadarOnline.com has also learned there are no witnesses to the incident between Charlie and Brooke, a good situation for the defense.
As RadarOnline.com reported earlier, Sheen’s legal team will actually try to discredit his wife’s recollection of events to the police because of her alcohol and drug problems. She had been drinking heavily and doing drugs in the hours before calling 911.
“Charlie is going to contend that everything Brooke told police isn’t true – that she was out of her head, that she was so messed up she didn’t know what was going on,” one source said.

The other thing Sheen has going for him is Mueller does not want to cooperate with prosecutors. And while she has to be careful about backing off her story because she could be prosecuted for making false statements to police, she also does not have to cooperate with prosecutors.
Colorado has cracked down on domestic violence cases and won convictions without the testimony of the beaten spouse but this case is more difficult for prosecutors because Mueller’s heavy drug and alcohol usage at the time of the incident will harm her credibility.

The prosecution has been busy building their case against Charlie Sheen over his Christmas Day incident with wife Brooke Mueller, but it seems they may have hit a slight bump in the road. RadarOnline.com has learned that key witness Patrol Officer Valerie McFarlane was just fired from the Aspen Police Department.

McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas and told police Sheen had held a knife to her throat and threatened to kill her. McFarlane was the officer that interviewed Mueller about the incident while the other officer, Rick Magnuson, interviewed Sheen.

“She is no longer working with the department,” an Administrative Supervisor for the Aspen Police Department told RadarOnline.com. “Her last day was last week.” An inside source told RadarOnline.com that McFarlane “was fired for a "series of episodes'", which includes attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy. The source says McFarlane also gained VIP access and “snuck her daughter and her daughter’s boyfriend into the VIP area.”

McFarlane's credibility has clearly taken a hit, which could be great news for Sheen’s defense team. However, a source tells RadarOnline.com that Chief Deputy District Attorney Arnold Mordkin “is not overly concerned about the impact of her firing on the case” because he’s sure “the 911 tape, in which we hear Brooke’s allegations and fear, takes care of the problem.”

McFarlane has had her fair share of domestic issues. In 2006, she petitioned for permanent custody of her daughter from the child’s father Alex Bracero, which she won in 2009 after almost three years of nasty court battles. In 2008, she was accused of grand theft auto, fraud and forgery in the state of Florida but formal charges were eventually dropped by the State’s Attorney’s Office. That same year, McFarlane was granted a permanent restraining order from ex-boyfriend Brian Deason after citing domestic abuse.
