Penn State Accused Of Sabotaging Legal Advice Given To School Officials Who Covered Up For Jerry Sandusky

Posted on Nov 20, 2011 @ 05:30AM - 8 comments

When Penn State's Athletic Director Tim Curley and University VP Gary Schultz testified before the grand jury investigating allegations of sexual abuse against the school's former football coach Jerry Sandusky, the two men were represented by the same high profile lawyer who represents the University.

That's a major conflict of interest, University of California legal professor Geoffrey Hazard says.

“In a way, it was worse than deliberately sabotaging them — it was unprofessional. And in another way, it was just stupid," Hazard told The Patriot-News on Saturday.

Both men went into their grand jury appearances with Cynthia Baldwin, a former State Supreme Court Justice who took over at PSU's in-house legal honcho in 2010.

Curley and Schultz are the two university officials Joe Paterno turned to after one of his football assistants, Mike McQueary, told him he'd witnessed Jerry Sandusky sexually abusing a 10-year-old boy in a shower on campus in 2002.

According to court records, when asked about Paterno's testimony, Curley and Schultz both denied they knew anything about a rape. They have both charged with perjury.

Baldwin's first priority would have been protecting the school, Hazard explained.  The University should have gotten Curley and Schultz outside counsel to advise them.

Curley and Schultz could file an ethics complaint, Hazard said. They might also opt to sue for malpractice.

“It is legally wrong to give bad advice if you have a conflict of interest,” he said. “And it was terrible advice.”

The mother of one of Jerry Sandusky's accusers says she and her son were "sickened" by the former Penn State coach's interview with Bob Costas on NBC's Rock Center Monday, in which Sandusky admitted he "horsed around with kids" naked in the shower, but denied molesting, or being attracted, to young boys.

"It sickened me, that he would be on TV, trying to downplay his charges -- and I think it made him look more guilty," the mother said Wednesday morning during an interview with ABC News.

"It's a planned out strategy to groom children to molest. He definitely shouldn't have showered with those kids. I mean I don't know anybody -- anybody -- who when somebody's like 50, would get in a shower naked with a 10-year-old."

Jerry Sandusky's attorney Joe Amendola told the Today Show on Tuesday morning that his client "showering with kids doesn’t make him" a pedophile, and that one of the witnesses to the ex-coach's alleged rapes could be lying.

Amendola said Sandusky "didn’t use a whole lot of common sense" when showering with the youths because of past incidents, but that it “doesn’t make him guilty” of molestation, in the video obtained by RadarOnline.com.

In an interview with NBC on Monday, Sandusky admitted he "shouldn’t have showered with those kids," but denied he's a pedophile, summing up his interaction with the boys as "horseplay."

Prosecutors asked District Judge Leslie Dutchcot that the 67-year-old defensive coach be held on $500,000 bail during his November 5 hearing, but she set the amount at a fraction of that number.

Dutchcot, who works as counsel for the law firm counsel to the firm Goodall and Yurchak, notes her participation with Sandusky's charity on her profile on the organization's website, as originally reported by Deadspin.com.

He was arraigned on 40 criminal counts -- 21 of them felonies -- including multiple counts of involuntary deviate sexual intercourse, corruption of minors, endangering the welfare of a child, indecent assault and unlawful contact with a minor, along with single counts of aggravated indecent assault and attempted indecent assault.

The mother of one of Jerry Sandusky's accusers breaks her silence to ABC's George Stephanopoulos, telling how she learned of the former Penn State coach's alleged sexual abuse of her son, his visits to the boy at school and her rage toward school officials for their lackadaisical response to the boy’s serious allegations.

The mother, who did not identify herself, was the first whistleblower on the 67-year-old defensive coach after her son (identified in the Grand Jury's report as Victim 1) told her Sandusky had been inappropriate in his conduct with him; she said her son emphasized how Sandusky used his tremendous influence and status to persuade his alleged child sex conquests.
