Judge Marsha Revel sentenced Lindsay Lohan to 90 days in jail, rejecting all excuses from the actress in a dramatic probation violation hearing on Tuesday in Beverly Hills.

RadarOnline.com is in the Beverly Hills courtroom and Judge Marsha Revel made the surprise ruling Tuesday, revealing that the SCRAM device showed Lindsay’s blood alcohol level at slightly higher than .03 shortly before midnight on June 7.

Later it went to zero and Lindsay had a private urine test much later showing it at zero.

The judge decided not to consider any of that and only to go with the report from Lindsay’s alcohol education classes.

The ruling could be a victory for Lindsay as it takes one more potentially damaging piece of evidence out of play. But the hearing was continuing.

On a side note, the judge turned down a request by Lindsay’s father Michael to speak to her in chambers. However, the judge did accept a letter presented to the court on behalf on Michael. The letter specificly stated that Lindsay belongs in an in-patient rehab center as opposed to jail.

The judge still denied Michael’s request as Lindsay looked exasperated. Michael has written a letter to the court.

An official from the Right On Program was scheduled to be called to testify about Lindsay’s alcohol education classes and her compliance.

Lindsay Lohan missed nine of her mandatory court-ordered weekly alcohol classes, it emerged in court Tuesday.

And the troubled star apparently dished up a host of excuses for her absence.

“Sometimes it was work, sometimes it was a delayed appointment,” the program’s co-owner Cheryl Marshall said, when grilled on the witness stand.

“Sometimes it was work, sometimes it was a delayed appointment,” the program’s co-owner Cheryl Marshall said, when grilled on the witness stand.

“One time she missed for a random drug test.”

It was also revealed that Lohan claimed she was stuck in North Carolina and couldn’t get a flight home in time for another session.

But in a stunning admission, Marshall admitted the program never checked on the validity of her excuse and did not notify the court of Lohan's absences.

In an often tense morning, Marshall presented some potentially damaging testimony in the case, which could see Lohan sent to jail if it is found she violated her probation.

When deputy district attorney Danette Meyers established that Lohan had not attended the alcohol education class weekly at the end of 2009 – despite a phone call from the judge spelling out what was required – Marshall turned argumentative.

That prompted Judge Marsha Revel to snap at the witness about the order she gave Marshall regarding Lohan’s terms: “Did you think I didn’t mean it?”

The judge later asked Marshall the same question.

Marshall said she thought it would come in the form of a directive.

However, under heavy questioning by Meyers, Marshall did admit that she told Lohan the judge had given her “enhanced terms” and “her attendance was required on a weekly basis.”

Right On employee Beryl Washington also took the stand.

Washington, an office manager for the program, admitted that the judge had told her Lohan needed to attend weekly meetings.

That was part of the morning battle that ended with Judge Revel ruling out evidence related to the SCRAM bracelet.

Meyers won an important battle early though, when the Judge Revel ruled that the prosecution should have access to the documents from Lohan’s alcohol education class.

The alcohol education program overseeing Lindsay Lohan's sobriety has been slapped with a subpoena to appear before a judge, RadarOnline.com is exclusively reporting.

Los Angeles County Deputy District Attorney Danette Meyers served the troubled actor's court-ordered alcohol education program, Right On Program, in Glendale, California, on Friday.

Staff, including the program’s director, were ordered to testify at Lohan's probation violation hearing on July 6.

RadarOnline.com has learned it followed an incident Thursday when the director of Right On Program refused to answer Meyers’ questions, as part of her ongoing and wide-reaching investigation.

"The program director cited privacy laws and wouldn't tell the District Attorney anything, which is very unusual because this has never happened before with any other defendant," said a source familiar with the situation.

"These are court appointed programs and the prosecutor frequently calls to ask questions -- and those questions are always answered."

RadarOnline.com has been told prosecutors have suspicions that Right On Program was covering for the 23-year-old Mean Girls star, who reportedly did not follow the rules and attend all meetings.

It has been claimed the starlet was late for her classes and did not attend enough meetings to be in compliance, although she passed the program.

"In a different program last year, Lindsay had frequent attendance issues," explained a source.

"At the beginning of the year, when she switched to Right On, she had no attendance problems at all.

"That doesn't necessarily mean that anything is amiss, but when the D.A. was shut down on the telephone by the program director, she decided to have them served with subpoenas so they will be required to testify under oath."

It's the latest blow for Lohan, who as RadarOnline.com revealed, had an alcohol level of .04 on the day her SCRAM bracelet went off.

Lindsay’s alcohol level ranged from .03 to .04 from midnight to 3 a.m, during the hours after the MTV awards, we confirmed.

Judge Marsha Revel ordered Lindsay not to consume alcohol and revoked her bail and set a higher new bail after the incident.

RadarOnlne.com has also revealed Lindsay’s SCRAM bracelet was tampered with.

The tampering would not have led to a false positive reading for alcohol, a source familiar with the situation told us.

It is not yet known how the bracelet was tampered with.

On Thursday, Lindsay’s reps announced that the actress took a urine test that indicated she had no alcohol in her system after the SCRAM bracelet went off.

But official documentation from that test has not been made public.
