Mexico's top prosecutor is taking over the Bruce Beresford -Redman case in a bid to secure his extradition, RadarOnline.com has learned exclusively.

The family of murder victim Monica Beresford-Redman, the Los Angeles restaurant owner murdered in Mexico, has used a private memorial service to vow justice will be done.

As RadarOnline.com was first to report, murder charges are likely to be laid on Monday against Monica’s television-producer husband, Bruce Beresford-Redman, who is suspected of killing her.
Bruce and the couple’s two young children, five-year-old Camila and three-year-old Alec, were not at the service at the Agape International Spiritual Center in Culver City, California, on Sunday.
In a silent statement from the family, Bruce’s name was not mentioned during the proceedings.

Last week, a judge granted a request by Bruce that the minors be kept away, because of the possible emotional stress and expected media attention.

Monica body was found in a sewer pipe April 8, near the Cancun resort hotel where the family had been staying.
Her husband, who is also a co-creator of MTV's Pimp My Ride, has been considered the chief suspect but no charges have been filed. He had been having an affair with a co-worker.
Despite being ordered to remain in Mexico pending the outcome of the investigation, he returned to Los Angeles last week and has been spending time with his two children at the family's home in Rancho Palos Verdes.
A recommendation to charge Beresford-Redman with the murder will be presented to a Mexican judge Monday, likely to be followed by an arrest warrant, according to Mexican attorney general Francisco Alor.

Mexican law enforcement authorities tell RadarOnline.com a murder charge is expected to be laid on Monday in the Monica Beresford-Redman murder case.
The state attorney general, Francisco Alor, has called Monica's husband, Bruce Beresford-Redman, the chief suspect in its investigation.

The former Survivor producer was ordered not to leave the country, but his attorney claimed he was under no legal restraint to stay in Mexico, so he fled.
"First thing Monday morning a record will be entered before court for the crime of homicide," confirmed Alor Quesada in an exclusive statement to RadarOnline.com, that did not mention Bruce Beresford-Redman's name.

Monica’s body was discovered inside a septic tank near from the up-market hotel where the couple was holidaying, in the hope of rebuilding their marriage, after an extra-marital affair was exposed.
She had been beaten and strangled.

While the attorney general’s office has filed a petition for the ex-Survivor Producer to return to Cancun so he can answer more questions about the brutal murder, Alor told RadarOnline.com it would now be up to a judge to issue a warrant for Beresford-Redman’s arrest.
"We have to be respectful of the judge's assessment who will take turn this matter into consideration against the person or persons, according to the evidence we send as part of our dossier," Alor said.
However, the attorney representing the family of the victim, has said that even if an arrest order is issued, the Mexican government would have to request Beresford’s extradition, a process that could take several years.
Mexican law also does not permit defendants to be tried in absentia.

Beresford-Redman's US-based attorney is pleading with Mexican authorities not to rush its decision.
Richard Hirsch cited other crimes that took place at the Moon Palace Hotel in Cancun, including a rape that happened just days after Monica was murdered.

"We feel this case should not be a rush to judgment," said Hirsch.
"We hope that the attorney general is not just trying to clear this case off his desk or in any way trying to protect the tourist industry of Cancun."

Bruce Beresford-Redman will ask a judge Friday to regain custody of his two children. A 10.30 am PT court hearing has been set in Los Angeles, and Bruce will ask for permanent guardianship of his children: Camila, 5, and Alec, 3.
His estranged in-laws are also fighting for custody.
Bruce is suspected of murdering his wife Monica during their recent vacation in Mexico. Her body was discovered inside a septic tank near the hotel where the couple was staying. He went to court ex-parte on Thursday in the custody matter and the judge scheduled a hearing for Friday.

The state attorney general, Francisco Alor, has told reporters in Mexico that he recently received the results of the forensic tests performed on the body of Monica Beresford-Redman.

Ledezma has also claimed the U.S. consulate in the Yucatan Peninsula must have facilitated Beresford’s exit from Mexico.
“The prosecutor’s office is holding the passport of Bruce Beresford. The U.S. consul made a commitment with the prosecutor that he would not leave the country and he did not comply,” the attorney told Spanish news agency Efe.

“It is evident that someone gave him permission to leave the country and to be able to enter the U.S. without problems and to continue his life as if nothing (had happened).”

Ledezma also called on Mexico’s foreign ministry to investigate how Beresford-Redman was able to leave the country.
The state attorney general confirmed it was still in possession of Beresford-Redman’s passport.

“Both he (the suspect) and the (U.S.) consulate and his lawyers were properly notified that he could not abandon the country and that he must present himself to public prosecutors at the times it might be required,” Alor said.

Looking calm and relaxed, Bruce was out and about with his father, David, just hours after an incident at his Californian home.
As RadarOnline.com revealed, there were dramatic and ugly scenes at the Rancho Palos Verdes home of Beresford-Redman, when he faced his estranged sister-in-law Jeane Burgos.
Not soon after entering the house, witnesses reported, yelling could be heard.

"Jeane stormed into the house... the next thing you know she came out of the house with one of the children and sped away," a witness told RadarOnline.com.
That child was four-year-old Alec.

"As Jeane was leaving the house she rolled down her window and said, 'Thank-you for watching us!' to the waiting media," the onlooker said.

Survivor producer-turned-murder suspect Bruce Beresford-Redman is back in the U.S., RadarOnline.com can confirm.
"Bruce Beresford-Redman has returned to Los Angeles County to be with his children and to attend to family and personal matters," his attorney Richard Hirsch told CNN.
