Charlie Sheen and Brooke Mueller Sign Divorce Agreement
Posted on Jun 16, 2010 @ 06:30AM - 8 comments

Charlie Sheen and Brooke Mueller have taken a major step toward their legal divorce, RadarOnline.com has confirmed.
The couple inked a 41-page agreement on the terms of a settlement for their split.
In it, the couple agree to share joint legal custody of their two children: Brooke will have primary custody, while the Two and a Half Men star will become dad on the first, third and fifth weekends of each month.

Brooke will also get $55,000 a month in child support.
She also receive a $757,689.70 lump sum.
RadarOnline.com has learned the agreement is a significant step for the troublesome couple who had been negotiating their split for some time.
It also paves the way for final divorce papers to be filed in court — a move that could occur soon — now that Brooke’s buy-out has been sealed.
Despite reports and denials otherwise, RadarOnline.com was the first to report that the couple was divorcing following the fallout of his Christmas Day incident in Aspen when he threatened her with a knife.

“They are not seeking a divorce nor has one been contemplated,” representatives for both Sheen and Mueller said in a joint statement, even after Brooke had moved out of their family home with no plans to return.

Sources previously told RadarOnline.com that both parties wanted to keep the divorce announcement under wraps until Sheen’s contract negotiations for Two and a Half Men were completed and until his criminal case in Colorado was over.

Despite having signed a detailed pre-nup with Sheen, Brooke has been obsessed with getting the same deal- if not a better one- that Denise Richards received in her high-profile divorce from the actor. RadarOnline.com reported in May that Sheen and Mueller had reached a secret financial divorce deal. “It’s not everything she wanted. It’s not even close. But it’s enough,” a friend said.

Though their divorce went public on Tuesday, Charlie Sheen and Brooke Mueller have been quietly planning the end of their marriage for months as RadarOnline.com has reported. Despite public statements to the contrary, the couple has spent the last months hammering out their divorce details including Brooke’s financial settlement.

“They’ve both been miserable in the marriage almost since the start. But they need to spin things right now because of the trial and the TV show,” a friend close to Brooke told RadarOnline.com in early May. Both Brooke and Charlie’s teams wanted to keep the divorce under wraps until his criminal case regarding his threatening of Brooke on Christmas Day was resolved and his contract negotiations for Two and a Half Men were finalized.

“She wanted more money but she’s happy with what she can get. She’s moved out and will never move back in,” the friend added at the time. “The reality is there for everyone to see. Both Charlie and Brooke relapsed. Both went back to rehab. Charlie was caught with another woman. Brooke moved out.

“And she’s told everyone close to her the marriage is definitely over and they’ve agreed it’s over.”
Despite the overwhelming evidence from friends, Charlie’s cavorting with women and Brooke’s move to a new home, both sides were still denying any movement towards divorce.

“They are not seeking a divorce nor has one been contemplated,” reps for the couple said in a joint statement, a denial picked up by many media outlets who incorrectly took it to be the truth.

Sheen inked his renewal deal with CBS in the middle of May, further clearing the road for the announcement of his inevitable divorce with Mueller. While he was dealing with his contract and court case in Aspen, his legal team was also hammering out a financial settlement with Brooke despite her having signed a prenuptial agreement.

“It’s not everything she wanted. It’s not even close. But it’s enough,” a friend said of Brooke’s settlement. Brooke had long been obsessed with the substantial amount Sheen’s ex-wife Denise Richards received. While the amount Brooke is getting is “substantial” it is “not a fortune” the friend said in May of the deal. “But it’s over and the hardest part has been worked out– the money.”
On June 6, Brooke put on a very public display of singlehood, stepping out on the red carpet of the Chrysalis Butterfly Ball without her wedding ring. In fact, she had not been wearing it for months as RadarOnline.com first reported in April.

Inside Charlie Sheen's Prenup: Wife Gets "Anniversary Payment" of $300,000
Posted on May 04, 2010 @ 03:58PM - 3 comments

The prenup between Charlie Sheen and Brooke Mueller is a thing of accounting beauty, relaying in charts and jargon down to the dime how much Brooke will or will not get if she and the actor ever split. Along with other startling revelations, the papers show that Sheen shells out an "anniversary payment" to Brooke for simply staying married!

"Charlie shall pay to Brooke...the annual sum of $300,000 (the 'Anniversary Payment'), payable within 30 days of the anniversary marriage," reads the document obtained by Gawker. The payment is valid for the first ten years of marriage and if the couple divorces before then and between anniversaries, the time will be prorated.

If Charlie fails to pay, Brooke can send him a notice of default and the payment will accrue interest.
Within the first 180 days of their marriage, Brooke received $500,000 and received stakes in Sheen's homes. In the event of divorce, Brooke will receive a $100,000 relocation fee and whichever of Sheen's cars she is currently driving.

Charlie also has to pay all of Brooke's living expenses which include (but are not limited to): food, clothing, vacations, recreation, gym, gifts to third parties, life insurance premiums, preparation of joint tax returns, household supplies, education, medical, nursery/child-related expenses, auto insurance, cosmetics, hair care, utilities, phone, entertainment and incidentals.

The prenup does shield Brooke from cashing on Sheen's money from the CBS hit Two and a Half Men. Which, based on the following sentence, second wife Denise Richards already had a stake in:
"Such gross income received is subject to commission expense, other business expenses, income taxes and certain provisions of an agreement pending finalization between Mr. Sheen and his ex-wife."
