Charlie Sheen’s plea deal collapsed because he was not eligible for the work release program his lawyers had planned on, RadarOnline.com has learned.

The program is only open for local Colorado residents with local jobs. Instead, Sheen must serve in the Useful Public Service program.
In the Useful Public Service program, there is a prohibition on tobacco use. Also, Sheen can only be out of jail between 10 am and 4 pm (instead of 8 am to 8 pm in the work release program).

Chain smoker Charlie Sheen got his attorney to ask Colorado jail officials if he could light up inside jail but that request went-up in smoke, RadarOnline.com has learned exclusively.
But the Two And A Half Men star WILL BE allowed to wear nicotine patches while he’s housed in cushy Pitkin County Jail in Colorado.

RadarOnline.com can confirm that Sheen will enter a ‘no contest/guilty’ plea on Monday to a single misdemeanor charge in exchange for the felony charge against him being dropped in connection with his alleged Christmas Day assault on wife Brooke Mueller.
A source told RadarOnline.com: “The deal with the District Attorney is for 30 days but that could go down to just 17 days with good behavior.

But even with the relatively short sentence, Charlie couldn’t imagine going without his cigs, and he had his attorney request smoking privileges.
“This request was refused although he can wear nicotine patches in what is considered a very cushy jail,” the source told us.
It’s still unknown which misdemeanor he will plea to – the criminal mischief for breaking Brooke’s eyeglasses or misdemeanor 3rd degree assault.

“The plea deal suits both parties,” the source added. “Charlie Sheen does not want to risk getting locked up in a federal prison so staying at Aspen’s jail for a short time suits him; while prosecutors don’t want to risk the potential embarrassment of losing at trial.”
In exchange for the plea deal it is not expected that Sheen will serve any probation upon his release, RadarOnline.com has learned.

A new court date of June 7 has been scheduled so that a plea deal can be presented to the judge.
If the plea deal is accepted, a June 18 motions hearing will be canceled and there will be no need to go to trial, which is now scheduled to begin on July 21.
Sheen will be required to appear at the Aspen courthouse on June 7 to enter the plea. He could potentially begin serving his jail sentence the same day the plea is entered.
If the star is jailed it is likely he will be housed at Pitkin County Jail in Colorado which is regarded as one of the cushiest jails in America.
The facility is decked out with plants, spacious living areas, a gym, plus televisions and other amenities. Amazingly, when not locked in their cells, inmates are allowed to mingle with the opposite sex in shared living areas – something that would no doubt appeal to Sheen.

Sheen was formally charged with felony menacing and two misdemeanors: 3rd degree assault and criminal mischief, in connection with his alleged Christmas Day assault on Mueller. Menacing, the most serious charge, carries a sentence of one to three years in prison if he is convicted.

Charlie Sheen may go to jail over his domestic violence case involving his estranged wife Brooke Mueller but it won't be too tough of a sentence. RadarOnline.com has learned that the actor's possible prison is one of the cushiest in America!

A source told RadarOnline.com that Sheen’s lawyer and the District Attorney’s office in Colorado are trying to work out a plea deal in which Sheen would spend some time at Pitkin County Jail if the prosecutors dropped the felony charge against him. In return, the Two And A Half Men star would plead guilty to a misdemeanor and do some jail time. Sheen’s lawyers are trying to haggle down the 45 days currently on the table.

His legal team is also trying to limit the amount of probation time factored into the deal because they don't want to risk the star compounding his problems if he gets in to trouble once again.

According to the source, Sheen is warming to the idea of prison because of what his life would be like inside the laid-back lockdown.

In addition, the jail is known for its excellent meals which are prepared at nearby Aspen Valley Hospital. When Sheen was arrested on Christmas Day following his altercation with Mueller prime rib was served for lunch and Cornish hen for dinner.

The jailers themselves include some colorful characters. Several are ex-cons who are known to treat the inmates with more compassion and understanding as a result of their own pasts. Both the inmates and jail staff are actively encouraged to get along and they even sit down and have lunches together so that they can establish friendly bonds.
“If you treat someone like an animal, you release an animal,” Pitkin County Sheriff Bob Braudis once said. Braudis is a pro-marijuana advocate and a humanitarian known for his compassion.

The jail is accredited by the National Commission of Correctional Health Care and Chief Jailer Don Bird says it is the smallest facility accredited and has been since the 1980's.
He recently told a local newspaper: “We don't see bad guys in here; we see guys who've made bad choices and face consequences for what they did.”

It's possible of course that Sheen could do his jail time somewhere else as local judges are open to allowing convicts to serve their sentences in other jurisdictions if they request this or if the circumstances dictate it. But with Pitkin's laid-back and care-free atmosphere, the actor would be crazy not to see out his time inside the Aspen facility.
