Petit Family Killer Won't Get Death Penalty, Predicts Lawyer: 'The Scale Tips In Favor Of Life'

After more than a month of testimony in the penalty phase of the trial of triple murderer Joshua Komisarjevsky, the extensive evidence is finally complete and his attorneys are confident about his chances of dodging the death penalty.

"The scale tips in favor of life," defense attorney Jeremiah Donovan predicted on Thursday, according to a report in the Hartford Courant, despite him being co-responsible for the most horrific murder in Connecticut's history.

As RadarOnline.com previously reported, Komisarjevsky was found guilty of 17 counts on October 13 for the grisly murders of Jennifer Hawke-Petit and her daughters, Hayley, 17, and Michaela, 11, and the vicious beating of their father on July 23, 2007 in their Cheshire, Connecticut home.

Stone-faced killer Joshua Komisarjevsky has barely shown a flicker of emotion throughout his murder trial and subsequent penalty phase but seeing his daughter via video finally sparked a reaction from him, RadarOnline.com has learned.

The nine-year-old girl was interviewed last week and despite her triple-murderer father objecting about the footage being played in the New Haven, Connecticut court, the jury saw her laughing and chatting to the camera on Wednesday, reported the Hartford Courant.

As RadarOnline.com previously reported, Komisarjevsky was found guilty of 17 counts on October 13 for the grisly murders of Jennifer Hawke-Petit and her daughters, Hayley, 17, and Michaela, 11, and the vicious beating of their father, Dr. William Petit, on July 23, 2007 in their Cheshire home. The jury is now deciding if he spends the rest of his life in prison or gets the death penalty.

The nine-year-old daughter of triple murderer Joshua Komisarjevsky will testify in court via video during the death penalty phase of his trial for the Petit family massacre, RadarOnline.com has learned.

The 31-year-old killer's defense team had asked that the girl be taped to provide evidence for the New Haven, Connecticut jury who is deliberating whether her father should be sentenced to death, or spend the rest of his life in prison, reported the Hartford Courant.

"The first time I met him he was still in jail for burglary," Caroline Mesel exclusively told RadarOnline.com. "My sister was friends with Josh and she wanted someone to go with her to visit him."

While he seemed normal at the time, after being dragged into Joshua Komisarjevsky's dark world Mesel now says she wishes she had never met him.

As the death penalty phase of the trial for convicted killer Joshua Komisarjevsky begins on Tuesday, it is his accomplice in the Petit family murders who has made a shocking confession in a series of chilling letters, RadarOnline.com has learned.

Steven Hayes, who was convicted last year for his part in the Cheshire, Connecticut home invasion that spiraled into a triple homicide, is awaiting execution on death row and wrote to a woman from prison claiming he was "sharing a dark secret,” reported the New Haven Register.

The 48-year-old convict described with relish how he had tied up and killed two women and admitted to murdering many more.

After eight hours of deliberations over two days, the jury found Joshua Komisarjevsky guilty on Thursday of the three grisly murders of Jennifer Hawke-Petit and her daughters Hayley, 17, and Michaela, 11, RadarOnline.com has learned.

The killer was found guilty of all 17 counts of murder, abduction and assault in the triple homicide of a mother and her two children, and the vicious beating of their father, Dr. William Petit, on July 23, 2007.

The capital felony verdicts mean that 31-year-old Komisarjevsky is eligible for the death penalty, like his accomplice Steven Hayes, who is currently awaiting execution on death row.

Despite the defendant's chilling confession earlier in the trial that detailed how he beat Dr. William Petit, the sole survivor in the horrific attack, on the head with a baseball bat and then sexually assaulted his 11-year-old daughter while she was tied to a bed, his attorneys are arguing that their client only intended to break in and steal the family's belongings, not to kill them.

After ten days of shocking evidence and disturbingly graphic details, the prosecution in the death penalty trial of Joshua Komisarjevsky rested it's case on Monday, RadarOnline.com has learned.

Since September 19, jurors in the New Haven, Connecticut courtroom have heard testimony from over 30 witnesses in the horrific case against the alleged killer, who is charged with 17 counts including murder, abduction and assault in the triple homicide of a mother and her two children, and the beating of their father.

The grisly case revolves around the seven-hour abduction of Dr. William Petit, his wife Jennifer Hawke-Petit and their daughters Hayley, 17, and Michaela, 11, who were held hostage in their Cheshire home on July 22, 2007.
