Former Penn State assistant coach Jerry Sandusky’s attorney has requested that a judge dismiss all 52 counts of sex abuse against his client, claiming they were too vague, too flimsy, or happened too long ago to be adequately defended in court.

Joseph Amendola argued that charges involving at least eight of the 10 boys that his client is accused of molesting fell outside the statute of limitations and that others could not be sufficiently substantiated by witnesses, reported the Boston Herald.

Joe Paterno Breaks Silence On Sex Abuse Scandal, 'I Never Heard Of Rape And A Man'

Posted on Jan 14, 2012 @ 08:53PM - 12 comments

By Radar Staff

Joe Paterno is finally speaking out about the sex abuse scandal that has embroiled Penn State for the last several months, costing him the job of head football coach.

Paterno's former assistant coach Jerry Sandusky is facing more than 50 counts of sexually abusing minor boys, with the allegations ranging from rape to inappropriate touching.

The university's athletic director and vice president have also been charged with lying to the grand jury investigating the allegations again Sandusky,

In a blockbuster exclusive with The Washington Post Paterno said he first learned there was a problem with Sandusky a decade ago when a young assistant, Mike McQueary, told him he'd witnessed Sandusky abusing a young boy in a shower.

“He was very upset and I said why, and he was very reluctant to get into it,” Paterno told The Post in his first interview about the case.

"He told me what he saw, and I said, what? He said it, well, looked like inappropriate, or fondling, I’m not quite sure exactly how he put it. I said you did what you had to do. It’s my job now to figure out what we want to do. So I sat around. It was a Saturday. Waited till Sunday because I wanted to make sure I knew what I was doing. And then I called my superiors and I said: ‘Hey, we got a problem, I think. Would you guys look into it?’ Cause I didn’t know, you know. We never had, until that point, 58 years I think, I had never had to deal with something like that. And I didn’t feel adequate.”

Paterno, who is now 85 and battling cancer, added that he didn't know what university procedure was in a situation like this. “So I backed away and turned it over to some other people, people I thought would have a little more expertise than I did. It didn’t work out that way.”

Paterno insisted that McQueary was unclear with him about the nature of what he saw, and added that even if McQueary had been more graphic, he’s not sure he would have understood.

“You know, he didn’t want to get specific,” Paterno told The Post. “And to be frank with you I don’t know that it would have done any good, because I never heard of, of, rape and a man. So I just did what I thought was best. I talked to people that I thought would be, if there was a problem, that would be following up on it.”

Paterno has not been charged with any crime, and now admits, "I wish I had done more."

New England Patriots offensive coordinator Bill O'Brien will replace Joe Paterno as Penn State's head football coach.

O'Brien's hiring will be announced by the university on Saturday, ESPN reported Thursday night. The 42-year-old will finish up his stint with Tom Brady -- who calls him a "great coach and friend” -- and the Pats at the conclusion of the NFL post-season.

Paterno, the longtime face of the institution was fired November 9 after 46 years on the job in the wake of the molestation scandal involving former defensive coach Jerry Sandusky. (Specifically, Paterno's ouster came as a result of a perceived non-response to a 2002 report from graduate assistant Michael McQueary that Sandusky had raped a 10-year-old boy in the school's locker room showers.)

By Adam S. Levy - Radar Staff Writer

Former Penn State defensive coach Jerry Sandusky Tuesday waived his preliminary hearing, moving forward with the trial in which he's accused of more than 50 criminal counts of child molestation and other sex offenses over a 15-year span.

Sandusky could have faced some of his accusers should the preliminary hearing have gone on; Tuesday's waiver, Senior Deputy Attorney General E. Marc Costanzo said, "provides maximum protection to, most importantly, the victims in this case.

"It avoids their having to testify for a second time," Costanzo said. "They will, of course, testify at a trial in the case."

UPDATE: 8:45 a.m. EST  Sandusky has just waived his right to a preliminary hearing, meaning he will not face his accusers in court today and the case is on the fast track to trial.

Former Penn State defensive coach Jerry Sandusky Tuesday will face his accusers in a Bellefonte, Pennsylvania courtroom for a preliminary hearing, in which prosecutors will try to prove there's enough evidence to move forward with a trial of the coach, who's accused of more than 50 criminal counts of child molestation and other sex offenses over a 15-year span.

The 67-year-old coach, who has maintained his innocence, is "looking forward to the opportunity to face his accusers," his attorney Joseph Amendola said Monday, noting Sandusky could even take the stand, if the situation warrants it.

No plea deal has been discussed with the prosecution, Amendola said. A veteran jurist will serve as district judge for the hearing, which could last more than a day.

By Radar Staff

Joe Paterno was taken to the hospital Saturday after a fall in his home resulted in a fractured pelvis.

The 85-year-old former Penn State football coach will not have to undergo surgery however, the AP reports but he is going to stay in the hospital because he needs to be kept stabilized, and wouldn't be able to travel to his doctor and the hospital for his on-going treatments for lung cancer.

Paterno hasn't been seen in public since he was fired from Penn State November 9 amid the ever-growing Jerry Sandusky sex scandal.

Joe Pa's former assistant coach has now been accused by 10 alleged victims of sexual molestation, ranging from rape to inappropriate touching.  He was arrested for the second time last week when accusers nine and 10 came forward, and new charges were added to the existing 40. He is currently out on $250,000 bail.

On Tuesday Sandusky will be facing many of those accusers in court for a preliminary hearing.

“As bad as it’s going to be — and I don’t have to tell you what the media frenzy’s going to be, it’s going to be crazy — but I think if we waive it, we’re losing a really important opportunity for Jerry, who maintains his innocence,” Sandusky's attorney Joseph Amendola told AP.

These are not happy days in Happy Valley.
