Survivor producer Bruce Beresford-Redman, who is accused of killing his wife, Monica, in Cancun, almost two years ago, has broken his silence from his jail cell in Mexico, and he says he didn't kill his wife, RadarOnline.com is reporting.

“This is the first time I’ve chosen to speak”, Beresford-Redman tells CBS' 48 Hours in an exclusive interview with the network that will air on Saturday night. “Everyone seems to have decided that I killed my wife. I didn’t kill my wife, I really didn’t.

Former Survivor producer, Bruce Beresford Redman's ex-sisters-in-law, are asking a judge to grant them custody of his two children from his marriage to Monica Burgos, whom he is charged with murdering, RadarOnline.com is exclusively reporting.

Monica was murdered in Cancun, Mexico over a year and a half ago, and her husband has been charged with the murder. Bruce is currently in jail in Los Angeles, as he appeals a judge's recent decision to have him formally extradited back to Mexico to face charges.

Monica's sisters, Jeane and Carla Burgos are asking Judge Mitchell Beckloff to grant them custody of Camila and Alec, who are being cared for by Bruce's parents, David and Juanita Beresford Redman.

The former Survivor producer’s attorney, Jaime Cancino Leon, has brought in three criminal experts to examine the criminal, chemical (blood) and medical (autopsy) findings, arguing that there is not enough evidence for probable cause, he revealed to RadarOnline.com in an exclusive interview. 

“What we’re saying is that the general attorney’s office didn’t do enough work to establish who killed her and how they killed her,” Cancino Leon explained.

The body of Bruce’s wife Monica Burgos was found April 8 in a sewer at the Moon Palace Hotel resort in Cancun, where the couple was vacationing.

“The criminal experts also conclude with us that the proof was not properly managed, the expert opinions in the files have mistakes, and conclusions of the authorities are not based on the proof,” Cancino Leon said.

In Mexico, the legal action that Cancino Leon is taking against the arrest warrant is called Amparo and is the equivalent of Habeas Corpus in the United States.

“We are arguing that Bruce’s constitutional rights have been violated because there’s not sufficient evidence to demonstrate probable cause in the murder they’re accusing him of,” Cancino Leon said, adding: “We have already offered their expert opinion in the Amparo trial and we’re waiting for the judge to either admit their (the experts) opinions or not.”

A court-ordered forensic expert will examine the authenticity of Monica Beresford-Redman’s last will and testament, RadarOnline.com is reporting.

Bruce Beresford-Redman, the former Survivor Producer who is still wanted in Mexico over the killing his wife, asked a Los Angeles judge on Tuesday to appoint the specialist, amid an ongoing legal fight with his wife’s surviving sisters.

A court-ordered forensic expert will examine the authenticity of Monica Beresford-Redman’s last will and testament, RadarOnline.com is reporting.

Jeane and Carla Burgos are challenging the validity of the 2008 document, which names Bruce as the executor and gives Bruce's parents an interest in a house Monica owned.

The remainder of her property would go to Bruce, according to the will.

"I have no reason why I would not allow Ms. Hahn (Bruce’s lawyer) to have her expert examine the will,” said Judge Mitchell Beckloff, who set a date of August 6 for the forensic study to be completed.

At the centre of the legal joust is the claim that there are no witnesses to validate Monica signed the document.

The couple’s former nanny, Maria Beatriz Oaxaca, who Bruce fired last month because she refused to support his innocence, is a potential key witness.

But the nanny reportedly says she knows nothing about Monica signing a 2008 will.

"Ms. Oaxaca said that is her signature on the document but that's not the document that she signed,” the Burgos’ attorney, Richard Petty, told court.

Petty has submitted a different will -- from 2004 -- in opposition to Bruce's claim.

In another twist, the court was told Bruce’s legal team is trying to find the couple’s former cook, who is also said to have witnessed Monica sign the document.

Petty also asked the court to appoint a special administrator to oversee the affairs of the estate, specifically, in regards to insurance policies.

"There was discussion that Beresford-Redmans are having trouble paying the mortgage on the Rancho Palos Verdes house and I think there's a need for people to notify life insurance companies of the litigation and make sure mortgage payments are being made,” Petty said.

But the judge said he would only consider such a move if evidence was presented to the court, which it hasn’t, to date.

While an arrest warrant remains active for the television producer, who is accused of beating and strangling Monica to death, Bruce is free to go about his normal business in California.

Bruce Beresford-Redman squared off against his slain wife Monica Burgos’ family in a Los Angeles court on Monday. The former Survivor producer, who is the only suspect in Monica’s murder, won a small victory when the judge sided with him regarding visitation of the couple’s two children.

An attorney for Carla Burgos, one of Monica’s sisters, requested one overnight visit a month and an additional hour during their current Tuesday and Sunday visits during the summer. "We're asking for an overnight because when the kids are with us they don't want to go back. They get very sad," Carla said. Bruce’s attorney asked for her comment to be stricken from the record and said that the Beresford-Redman family was willing to work with the Burgos family.

Carla says the night before Monica left for her vacation in Cancun, “Bruce came to my house and began pounding on the door. He was in a rage. First, he asked my son Nicolas, ‘Where are the boxes?’ Apparently, Monica had told him that the boxes were at my house. Nicolas asked him ‘What boxes?’ I told Bruce that Monica took them. He became very angry and said, ‘No, she didn’t. ‘ He then turned around and slammed the door as he left. I had never seen Bruce so out of control since I have known him.”

Carla revealed that Monica was thinking of getting a divorce and moving out of the house. “She talked about getting a condominium in Santa Monica so the children could be by the beach,” she states.
