The legal eagle is yet to comment.

Lohan was spending her final night of freedom dealing with a game of lawyer swap, after Robert Shapiro, most well-known for being part of O.J. Simpson's defense team, informed the Judge Marsha Revel he was no longer representing her.

But a source close to Lohan insisted, “Shawn never really left, Bob had been there guiding us... he was great, but he was just consulting, that’s all he ever was.”

Chapman Holley never signed the substitution of attorney form last Friday, a move that would have rid her of the case for good.

Shapiro’s sudden and abrupt move, which coincided with Lohan checking out of the sober house he runs, prompted speculation that Lohan would attempt to appeal Judge Revel’s decision.

But the source, familiar with Lohan’s state of mind, insisted: “She’ll be there in court.”

Lindsay’s in a really good place,” added the source. “We’re all in a really good place... but, you know she’s scared. It’s just a compete circus.”

The Deputy District Attorney who prosecuted Lohan, Danette Meyers, said she was unaware why Shapiro had quit the case or whether Chapman Holley would be in court when the actress surrenders.

“My advice to the defendant, Ms. Lohan, is to show up tomorrow, on time,” Meyers told RadarOnline.com.

“If not, the People will be asking for a bench warrant, immediately."

The District Attorney whose prosecution sent Lindsay Lohan to jail has issued a warning to the troubled star and her legal team on the eve of her surrender to the court -- if you appeal, we’ll fight it.

Los Angeles County Deputy District Attorney, Danette Meyers, told RadarOnline.com she would object to any move to send Lohan to rehab, instead of the slammer.

"I have two things to say about that, first, she had done an in-patient rehab program before -- and it didn't work,” said Meyers.

“Secondly, Judge Revel has already sentenced her. She needs to do the time. Jail is the only thing that is going to get her attention.”

Lohan’s new attorney, Robert Shapiro, met Judge Marsha Revel in her chambers for a confidential meeting Monday, as Lohan began moving out of the sober house where she has been living for the past five days.

Meyers said she didn’t even know about the meeting because she was in another court, when a message was left for her.

"If Mr. Shapiro wants to meet, he should have notified me,” she told RadarOnline.com.

“I never got any notice that there was a meeting scheduled in chambers, so I didn't appear. I was in court all afternoon and didn't get the message until I got back to my office around 4:30 p.m."

Shapiro was at the courthouse for only a short period of time.

He has refused to comment about the meeting.

Meyers admitted Lohan could stay out of jail if Shapiro filed an appeal on behalf of his client, but she warned: "I don't believe it will be fruitful and my office would file a response."

The Mean Girls star is scheduled to surrender tomorrow morning at 8:30am in Beverly Hills.

EXCLUSIVE DOCUMENT: Michael Lohan Asks Judge To Include Prescription Pills As Part Of Lindsay's Drug Testing

Posted on Jul 09, 2010 @ 12:45PM - 32 comments

As Lindsay Lohan counts down the days to the start of her jail time, her father Michael Lohan is still determined to get her off prescription medication.

As Lindsay Lohan counts down the days to the start of her jail time, her father Michael Lohan is still determined to get her off prescription medication.

Read The Letter

And to prove his point, he’s fired off a stern letter to the court asking that her random drug testing include checking for prescription drugs, RadarOnline.com has confirmed exclusively.

VIDEO: Lindsay Lohan Sentenced To 90 Days In Jail

As RadarOnline.com reported, Lindsay’s probation report confirmed she has prescriptions for several powerful medications including Nexium (for acid reflux), Zoloft (antidepressant), Trazadone (antidepressant), Adderall (a stimulant used for attention deficit disorder) and Dilaudid (a painkiller).

PHOTOS: Lindsay Lohan & Parents Arrive In Court

Michael’s letter to the court calls Lindsay’s prescription drug use “a giant legal loophole.” The letter explains that Lindsay continues to test positive for amphetamines and opiates but is not violating her probation because she has a doctor’s ‘OK’ to take those prescription medications.

PHOTOS: Celebs Who Have Done Jail Time

“The defendant was tested for drugs and alcohol on May 27, 2010, and the test was positive for amphetamines,” the letter reads. “This is not a violation of probation as the test result is positive because of the drug Adderall. The next two tests on June 2, 2010, and June 7, 2010, were positive for amphetamines and opiates. This is not a violation of probation, as these tests were positive for Adderall and the pain medication Dilaudid.”

Pamela Hasselhoff Starts Jail Sentence

The letter continues, “Mr. Lohan does not believe his daughter has any medical reason to take any prescription drugs at all, much less regular use of amphetamines and opiates. She is in good health. Mr. Lohan therefore asks the court to disallow these prescription medications immediately, and to disallow them for the remainder of the term of her probation, including during any period of incarceration. Mr. Lohan also believes strongly that the doctors who are prescribing them should be investigated for unlawful over-prescribing of medication.”

EXCLUSIVE: Lindsay Lohan's Alcohol Program Served With Subpoena

Posted on Jun 18, 2010 @ 04:25PM - 26 comments

The alcohol education program overseeing Lindsay Lohan's sobriety has been slapped with a subpoena to appear before a judge, RadarOnline.com is exclusively reporting.

Los Angeles County Deputy District Attorney Danette Meyers served the troubled actor's court-ordered alcohol education program, Right On Program, in Glendale, California, on Friday.

Staff, including the program’s director, were ordered to testify at Lohan's probation violation hearing on July 6.

RadarOnline.com has learned it followed an incident Thursday when the director of Right On Program refused to answer Meyers’ questions, as part of her ongoing and wide-reaching investigation.

PHOTOS: Lindsay Lohan Gets In Fighting Shape

"The program director cited privacy laws and wouldn't tell the District Attorney anything, which is very unusual because this has never happened before with any other defendant," said a source familiar with the situation.

"These are court appointed programs and the prosecutor frequently calls to ask questions -- and those questions are always answered."

Lindsay Lohan's Assistant Quits

RadarOnline.com has been told prosecutors have suspicions that Right On Program was covering for the 23-year-old Mean Girls star, who reportedly did not follow the rules and attend all meetings.

It has been claimed the starlet was late for her classes and did not attend enough meetings to be in compliance, although she passed the program.

"In a different program last year, Lindsay had frequent attendance issues," explained a source.

"At the beginning of the year, when she switched to Right On, she had no attendance problems at all.

PHOTOS: Lindsay Lohan Packs A Punch

"That doesn't necessarily mean that anything is amiss, but when the D.A. was shut down on the telephone by the program director, she decided to have them served with subpoenas so they will be required to testify under oath."

It's the latest blow for Lohan, who as RadarOnline.com revealed, had an alcohol level of .04 on the day her SCRAM bracelet went off.

Lindsay’s alcohol level ranged from .03 to .04 from midnight to 3 a.m, during the hours after the MTV awards, we confirmed.

Judge Marsha Revel ordered Lindsay not to consume alcohol and revoked her bail and set a higher new bail after the incident.

RadarOnlne.com has also revealed Lindsay’s SCRAM bracelet was tampered with.

The tampering would not have led to a false positive reading for alcohol, a source familiar with the situation told us.

It is not yet known how the bracelet was tampered with.

On Thursday, Lindsay’s reps announced that the actress took a urine test that indicated she had no alcohol in her system after the SCRAM bracelet went off.

But official documentation from that test has not been made public.

We were there when the subpoenas were served -- and video will be posted shortly.

DNP Random Things

Lindsay Lohan is turning to Twitter to defend herself against reports that her SCRAM bracelet went off during the MTV Awards.

PHOTOS: Lindsay Lohan Family Photo Album

She writes “My scram wasn't set off-Its physically impossible considering I've nothing for it to go off”

The actress may get a chance to tell that to the judge! And even if she doesn’t – it’s still going to be discussed in court.

Despite Lindsay’s protestations, an emergency meeting has been scheduled with her attorney Shawn Chapman Holley and prosecutor Danette Meyers at 3 p.m. PT Tuesday, as RadarOnline.com reported exclusively.

PHOTOS: Lindsay Falls Head Over Heels

The SCRAM bracelet monitors alcohol use. And, Judge Marsha Revel has ordered that Lindsay not drink any alcohol. If she did indeed trigger the bracelet, she would be in violation of her probation. Lindsay’s tweet ends with “All of these false resports (sic) are absolutely wrong.”

Later she tweeted, “This is all because of a FALSE accusation by tabloids& paparazzi& it is f*****g digusting- I've been more than I'm compliance & feeling great.”

PHOTOS: Lindsay’s Hot SCRAM Dress

But what Lindsay doesn’t know is that the SCRAM execs have delivered a report to the judge. That report should tell the judge if Lindsay is in violation or not.
