EXCLUSIVE INTERVIEW: Jon Gosselin's Legal Limbo; Attorney Doesn't Know If He Is Still Representing The Father-Of-Eight

Despite Jon Gosselin’s Tweets that he’s fired divorce attorney Anthony List for making disparaging statements about ex-wife Kate, in a bizarre twist, List tells RadarOnline.com he is still on the case.
Gosselin released a statement today saying that he’s terminated List. "Mr. Anthony List Sr., Esq. is not my representing attorney; I terminated him on April 15, 2010,” he Tweeted.

The former Jon & Kate Plus 8 star was reportedly angry that List had announced that he was moving forward with an ‘absentee mom’ argument against Kate Gosselin regarding custody of their children.

But despite the apparent confusion List claims that he has Jon’s best interests at heart and only wants to protect Gosselin until he has new legal representation officially in place.

He told RadarOnline.com: “Look, I contacted the clerk at Berks County Court yesterday and my name was still on the file.

PHOTOS: Kate's Home And Gone

“As an officer of the court I need to protect my client and I don’t want Jon to be left in grave prejudice – I don’t want to see him hurt.”

“I just want a lawyer’s letter, and for the court to tell me they have an ‘entry of appearance’ so that everybody can breathe easy.

“This is really important because these are the most serious negotiations of Jon Gosselin’s life and he needs to protect himself and the rights of his children too.

“There is another status conference scheduled for May 7, 2010, before Judge Timothy Rawley at Berks County Court and at present I am still scheduled to represent Jon at this time.

“Due to attorney and client privilege I cannot reveal specifics about what Jon and I discussed in private regarding his kids. Obviously, he wants an input about where and when he gets to see his kids and that is a big concern to him.”

Kate’s Lawyer Mark Momjian told RadarOnline.com earlier today: “We want to encourage dialogue between the parties in the hope that all issues are resolved amicably - that makes sense for the parents and more importantly for the Gosselin children."

EXCLUSIVE: Jon Gosselin Finds A New Place To Live

DNP Random Things

Jon Gosselin is moving into his own place near the home he used to share with Kate and their 8 kids, RadarOnline.com has learned exclusively.

In an exclusive interview, Jon’s lawyer Anthony F. List told RadarOnline.com that Gosselin has “rented a large apartment in Reading PA with several bedrooms” and that “he signed the lease just the other day.”

PHOTOS: Jon Gosselin - A Hole Lot Of Trouble!

“He’s secured a property in Reading. There’s a lot of room with lots of open space. It’s really beautiful,” List told RadarOnline.com.

Last week Jon filed court papers requesting physical custody of the Gosselin kids as well as the right to live in Kate’s guest house. As RadarOnline.com reported, Jon has been living with his brother since breaking up with girlfriend Morgan Christie.

Kate’s attorney, Mark Momjian called the filing “procedurely flawed” and told RadarOnline.com that, among other things, Jon hadn’t even listed a current address.

Jon’s attorney, clearly annoyed, responded to Momjian’s statements, saying: “Grow up. For obvious reasons, we did not want to put down Jon’s address. It would have created havoc for him, his neighbors and his brother. I think it was an unfair comment for Momjian to make when he knows full well that it has nothing to do with the merit of what I filed.”

On Thursday, Momjian continued to articulate his position, saying that Jon should continue to pay child support no matter what Kate is earning now.

“I would agree that Jon needs to pay child support,” List told RadarOnline.com. “There’s no question about it…it’s an obligation of both parents. But it has to be based on what their ability to pay is, what their income is. Throughout the entire proceedings with Jon and Kate, there’s never been any information put on the table about either one’s income or expenses.

PHOTOS: Hollywood's Dirtiest Divorces

“Kate has tremendous sources of income and as long as she’s portrayed as this wonderful mother and this flawless golden girl then her value continues to rise.”

List says that overall Jon is just trying to “be a good guy.”

PHOTOS: Kate Gosselin Prepares For Dancing With The Stars

“He’s not trying to take the kids away from Kate, he’s not trying to destroy the relationship they have with them,” List told RadarOnline.com. “The nice thing is that there have been nice compliments going back and forth with both of them. Kate has said that Jon really loves their children and is a good father.

“But they need to get to the issues at hand and stop fighting over things that are tearing them apart and most importantly, tearing the kids apart.”

Kate Gosselin is fighting back! As she heads to work in Los Angeles for Dancing With the Stars, Kate’s lawyer filed papers on Monday in Pennsylanvia refuting her ex-husband’s custody request. Kate’s lawyer Mark Momjian exclusively told RadarOnline.com that Jon’s filing was “cleary defective,” and has filed papers asking the court to dismiss Jon’s request.

“We are asking the court to dismiss Jon’s complaint for its utter failure to comply with procedural rules imposed by the court,” Kate’s lawyer said. Jon has requested full custody of their eight children, saying that Kate was an absentee mom since she is working out of state.

“We think the court will dismiss his complaint,” Momjian told RadarOnline.com. “This case stands apart in its failure to abide by the rules.”

Jon has not listed an address on the papers and Kate’s lawyer said this was basic information required for someone requesting custody. “He’s required to list his address and identify the adults he lives with where he is residing,” Momjian explained. As RadarOnline.com exclusively noted, Jon has spent weeks away from his children living with his many girlfriends since he left Kate.

As RadarOnline.com previously reported the divorce between Kate and Jon Gosselin was finalized Friday. And as RadarOnline.com also reported Kate Gosselin is very happy with the outcome and with the financial compensation she has been awarded.

EXCLUSIVE: Jon And Kate Divorce Official - Kate Walks Away With The House And Most Of The Cash

One thing that Kate must be happy about for sure is that her newly ex-husband has been ordered to pay child support to the mom of 8, a fact  confirmed by her lawyer, Mark Momjian.

PHOTOS: Jon Gosselin Has A Gun

"Yes,  part of the arbitration award consisted of a decision on property division and  child support," Momjian tells RadarOnline.com in an exclusive interview. "And the amount of the child support goes from him to her and not the other way around."

But when it comes to how much (RadarOnline.com has been told by a source close to the situation that it's a "bundle" of money) Momjian is keeping mum, saying, "I can't confirm it. We haven't disclosed what the amount was.

PHOTOS: Jon And Kate Send The Kids To School

"But, look, we¹re talking about 8 children here and the enormous expense that goes into raising those children, you¹re obviously going to have to deal with the reality of considerable financial support.

"It was an issue that was agreed to be presented to the arbitrator and part of the resolution was that an obligation was imposed (on Jon).

"We're just hoping that it doesn't become an issue down the road."

As far as who got what, Momjian said, "We're trying to keep a little bit of the privacy, given that in the arbitration both parties agreed not to disseminate information.

PHOTOS: Jon Tries To Dance

"It's a very detailed award that goes through all the allegations and I think the reality is that the parties felt it would benefit both of them to not disseminate it.

"So, I've got uphold that standing.

"But it does bring to bear one point and that is that one of Kate's primary objectives was to stay in the family home with the children and that's what  she's going to continue to do.

PHOTOS: Jon Is A Vegas Party Boy

"That was her focus from the beginning of the case and it's still her focus.

"It's important for the children¹s stability and continuity of care that  they stay in an environment that's familiar and promotes their happiness.

"To the extent that Kate will be there with her children in her role as primary parent, that's something we're very proud of accomplishing and we're relieved."

EXCLUSIVE INTERVIEW: Kate’s Lawyer Reveals Jon HASN’T Returned The Money!

Not so fast, Jon Gosselin!

Despite the fact that his lawyer Mark Heller said Jon was in “complete compliance” with a court order that required him to return $181,000 he took from the couple’s joint bank account, Kate’s lawyer tells RadarOnline.com that’s not true.

Mark Momjian revealed to RadarOnline.com that Jon has only put back $28,500!

Heller said earlier Friday that Jon had put back the money but that’s not so, says Kate’s lawyer Momjian, who also questions why Heller is speaking for Jon.

Momjian told RadarOnline.com: “Mr. Heller doesn’t represent Jon Gosselin in the divorce action in state of Pennsylvania so it’s a little puzzling to us why he’s making statements on a case he is not counsel of record on.

“He’s withdrawn his application to be admitted specially in Pennsylvania.

“All I can tell you is Jon Gosselin has until Monday to put all the money back and we hope he complies.

“We’ve only seen a very small a very small partial compliance as of today but he has until Monday.

“Regardless of Mr. Heller’s comment, we haven’t received confirmation that he’s returned the $151,500 that he needs to pay to bring his total to $180,000.

“We don’t have confirmation of that.

“Mr. Gosselin has a Pennsylvania lawyer and I would think that he would be talking to him, not Mr. Heller.”

The money was supposed to be sent into wife’s counsel escrow account and $28,500 has only been confirmed as of now.

Momjian also said: "My client would be relieved to report that he (Jon) has fully complied...I would be relieved, too!

"But he hasn't as of now."

UPDATE: Momjian also told RadarOnline.com: "We got an email at 1:23 (ET) this afternoon saying that Jon Gosselin purportedly had sent $152,000 to his lawyer in Pennsylvania.

"The money had not come to us yet, per the court order's directive. Jon's lawyers is making a representation that the money is with him; the court order required that the money is to go to us. We're waiting for it."

Jon’s lawyer had said earlier Friday that Jon was in compliance with the court order. But, as Momjian points out Jon is not in compliance and won’t be until the money is in the account.

Momjian told RadarOnline.com that that Jon has until Monday to be in compliance "but he is not in full compliance as of yet."

And that’s the bottom line!

Jon Gosselin's threats to have the production of Kate Plus 8 halted will fall on deaf ears, Kate Gosselin's attorney, Mark Momjian, said on the Today Show Friday.

"These parties entered into an agreement once the divorce action was filed that allowed each parent -- who had physical custody of the children -- to make the filming decisions when the children were with them," Momjian said.
