Casey Anthony Defense Team Asks For Mistrial -- Again

Posted on Jun 27, 2011 @ 02:45PM - 8 comments

By Alexis Tereszcuk - Radar Senior Reporter

Casey Anthony’s defense team asked for another mistrial on Monday according to a motion they filed in the afternoon.  Casey, 25, is being tried for the first-degree murder of her two-year-old daughter Caylee Marie, and if convicted she may get the death penalty.  Her defense cited a recent federal court ruling that said Florida’s death penalty statute is unconstitutional and they want Judge Belvin Perry to “declare a mistrial in this case and begin jury selection anew with a non death-qualified jury.”

This is the latest legal maneuver by the defense to declare a mistrial and came just hours after the judge ruled that Casey was competent enough to continue with the trial.  Her lawyers submitted a motion on Saturday to have Casey evaluated by three mental health experts.  The trial was subsequently halted and three doctors met with Casey over the weekend.

It has been three years to the day that little Caylee Anthony died and her mother’s legal team started off their defense by questioning evidence from law enforcement.

On Thursday, Casey Anthony’s lawyer actually got into an argument with the prosecution after he asked FBI technician Heather Seubert if she had performed a paternity test relating to Caylee.  He was trying to show that law enforcement had some suspicion that Casey’s own brother, Lee Athony, was Caylee’s father.  Seubert admitted that she had indeed been asked to test Lee Anthony, to see if he was Caylee’s biological father.

The state attorney Jeff Ashton loudly objected to the line of questioning and that is when the two attorneys started arguing.

Casey Anthony broke down in tears during another day of shocking testimony in the murder trial of her 2-year-old daughter when she heard that Caylee’s bones had been chewed on by wild animals in the woods.

John Schultz, a University of Central Florida forensic anthropology professor, told the jury that two large leg bones that were recovered had “actually been chewed on by animals.”  Casey burst into tears as she heard this testimony.  She was visibly shaken and grabbed tissues and wiped her eyes and face while shaking her head back and forth.  She was comforted by one of her defense attorneys.

Judge Belvin Perry ended the trial early on Thursday after Casey became “ill,” following the display of gruesome photos of her daughter’s skull that was found in December 2008. She has cried through the last few days, never looking up at the evidence photos and keeping her head bowed.
