Jon, according to a source with knowledge of the situation, does not want the divorce immediately finalized as he is facing an expensive lawsuit from TLC. He’s hoping that if his money is still pooled with Kate’s the network, which plans to keep working with Kate, will take it easier on him.

TLC is suing Jon for breach of contract and will go to court seeking a preliminary injunction in December. Jon Gosselin entered into a secret deal to earn money in violation of his TLC contract, and RadarOnline.com has obtained the document that proves it.
The document is a contract that spells out a business relationship between Jon, Hailey Glassman, Mike Heller and Michael Lohan.

Actually it won’t be a referee, but they will be monitored by a court-appointed arbitrator.
RadarOnline.com has learned exclusively that the warring couple will come face-to-face within the next several days to hammer out details of their divorce.

After talking about each other in separate national TV interviews for months, Jon and Kate will now face off behind closed doors and division of money is still a significant issue, sources tell RadarOnline.com exclusively.
Potentially complicating a resolution is the fact that Jon is being sued by TLC for breach of contract. He not only faces large legal bills but also could be on the hook for a huge sum of money if TLC prevails and is awarded damages. One scenario has Jon dragging out the divorce so that the couple’s money is still pooled – with Jon hoping Kate will convince TLC not to proceed against him because it will take money away from her and the kids.

But Kate doesn’t want to drag out the divorce. And if she has her way and the marriage is officially dissolved, the reality TV dad will be on his own if it comes time to pay TLC, and that bill could be astronomically high.

TLC is represented by Williams & Connolly, one of the best law firms in the country. Lead attorney Paul Gaffney has lined up a slew of depositions with people who were close to Jon during the past few months when TLC alleges he breached his contract and went rogue on the network. In addition, TLC is moving ahead with its attempt at a preliminary injunction against Jon and if it is granted Jon will not be able to trade off his “fame” for cash in paid interviews and appearances as he has been doing. He will also be restricted from pursuing other TV projects.

Jon has been in Hawaii for the past several days. One source says that instead of the harsh rhetoric he’s been using against Kate, he’s now ready to try a more conciliatory approach. Sources close to Kate say she wants to move on with her life as quickly as possible.
