Casey Anthony might be out of jail, but her lawyer Jose Baez is fighting his own legal battle over the handling of his famous client’s case.

“We are investigating an open complaint regarding Jose Baez,” the Florida State Bar spokesperson confirmed to RadarOnline.com on Thursday.

The investigation into Jose Baez is related to Casey’s probation issue, according to the Orlando Sentinel, after Judge Belvin Perry held an emergency hearing on August 5 to determine if Casey should serve probation that her attorneys claimed she served while behind bars.

Casey Anthony doesn’t have to return home to Orlando, Florida – at least for the time being.

Judge Belvin Perry, during an emergency hearing Friday morning in Orlando, said he'd need more time to consider the facts before ruling on whether or not Casey Anthony must return home to serve probation for check fraud.

"I'll be the first to admit this is not a very clear cut issue ... you’ve given me a lot to think about " Perry said, calling it "a legal maze" and "a mess".

Casey Anthony’s defense team is back in court Friday morning, asking a judge to overrule another judge’s order forcing the notorious ‘Tot Mom’ to return to Orlando, Florida  to serve probation for a check fraud conviction, and RadarOnline.com is live streaming the hearing.

Anthony does not have to personally attend the emergency hearing before Orange County Judge Belvin Perry -- the same judge who presided over her murder trial.

UPDATE: Judge Belvin Perry has ruled that Casey Anthony does not have to report to the state probation office on Thursday.  He will hold a hearing on the matter on Friday at 9 a.m.  Casey is not required to attend the hearing.

Casey Anthony has been ordered to return to Orlando, Florida by 10 am on Thursday to report to the probation office, a state corrections official announced on Wednesday.

The original justice in the matter, Judge Stan Strickland, removed himself from the check-fraud case on Wednesday, one day after Anthony’s defense team filed an emergency motion attempting to block her forced return to the Sunshine State.

Casey Anthony's legal battle continued on Tuesday when her attorneys attempted to block a judge's order for her to return to Orlando to serve her probation.

Cheney Mason filed an emergency motion requesting a hearing to "quash, vacate and set aside," Judge Stan Strickland's order for Casey to return to Orlando, Fl. and serve her probation according to the Orlando Sentinel -- accusing the judge of "unbridled prejudice," following his statements made on TV after Casey's acquittal.

Mason claimed the judge's order on Monday requiring Casey to return to Orlando within 72 hours to serve one year of supervised probation was "made with reckless disregard for Ms. Anthony's due process and civil rights."
