Charlie Sheen’s domestic abuse case will be heard on June 18 after Judge James Boyd ordered a new date for a motions hearing, during a status conference today in Aspen, Colorado, RadarOnline.com has learned.
The troubled actor’s lawyer Richard Cummins will try to persuade the judge during that hearing that Sheen made a series of inadmissible statements to local police officer Rick Magnuson, because he was not read his Miranda rights while being questioned at the home he and Brooke Mueller rented.
New Lawyer Appears In Sheen Court Case
Patrol Officer’s Valerie McFarlane and Magnuson were the arresting officers who were called to the rented home on Christmas Day after Mueller made an emotional 911 call claiming that the actor had held a knife to her throat and threatened to kill her.
He will also request personnel files on the two officers at the next court date.

Celebrity lawyer Hal Haddon was at today’s hearing but remained tight-lipped when asked if he was now part of ‘Team Sheen’.
Sheen’s current lawyer Richard Cummins said: “Mr Haddon is not working for the defense right now.”

Despite this denial it is now widely expected that Haddon will join the effort to keep the star out of jail - neither Sheen or Brooke Mueller were present inside the courtroom for the brief hearing.
The Two And A Half Men star has been charged with felony menacing and two misdemeanors: 3rd degree assault and criminal mischief, in connection with his alleged assault on Mueller.

The actor has pled not guilty to all three charges. If convicted on all three counts, he could face between two and six years in jail.
It is fully expected the Two And A Half Men star’s legal team will claim at trial that no crime happened. Sheen’s lawyers are also gearing up to attack the credibility of local Patrol Officer Valerie McFarlane who is no longer employed by the Colorado Police Department.

Charlie Sheen will fight for his freedom beginning Monday when he faces three domestic violence charges stemming from an incident with Brooke Mueller and RadarOnline.com has learned that his defense will attack the credibility of the police officer who interviewed Mueller at the scene.
RadarOnline.com has also learned that there are no independent witnesses to whatever happened between Brooke and Charlie, complicating the prosecution’s efforts to convict the Two and a Half Men star.
A source close to the situation told RadarOnline.com that Assistant District Attorney Arnold Mordkin and his team will heavily rely on Mueller’s emotional 911 call where she claimed Sheen had a knife, threatened her and that she was scared for her life.

The Two And A Half Men star’s legal team, meanwhile, will claim that no offense happened and are gearing up to attack the credibility of local Patrol Officer Valerie McFarlane who has just been fired from the Colorado Police Department.
McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas.
She was the officer that interviewed Mueller about the incident while the other arresting officer, Rick Magnuson, who interviewed Sheen, also has a murky past. Mueller told McFarlane that Sheen held a knife to her throat and threatened to kill her.

McFarlane was fired from the police department for a series of incidents, which included allegedly attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy.
She also reportedly gained VIP access and snuck her daughter and her daughter’s boyfriend into the VIP area.
A source told RadarOnline.com: “It’s going to be very interesting because there does not seem to be any plea deal on the horizon and both sides believe they have strong arguments to make.

“Mordkin does not believe that the defense bringing-up McFarlane’s credibility is as strong as Mueller’s actual 911 call.
“It should make for an explosive situation and the stakes have never been higher for Charlie Sheen at this stage in his career.”
Sheen is facing one felony and two misdemeanor charges in connection with the domestic violence incident - since the Christmas arrest he has entered rehab and so has his wife Brooke Mueller.

RadarOnline.com has also learned there are no witnesses to the incident between Charlie and Brooke, a good situation for the defense.
As RadarOnline.com reported earlier, Sheen’s legal team will actually try to discredit his wife’s recollection of events to the police because of her alcohol and drug problems. She had been drinking heavily and doing drugs in the hours before calling 911.
“Charlie is going to contend that everything Brooke told police isn’t true – that she was out of her head, that she was so messed up she didn’t know what was going on,” one source said.

The other thing Sheen has going for him is Mueller does not want to cooperate with prosecutors. And while she has to be careful about backing off her story because she could be prosecuted for making false statements to police, she also does not have to cooperate with prosecutors.
Colorado has cracked down on domestic violence cases and won convictions without the testimony of the beaten spouse but this case is more difficult for prosecutors because Mueller’s heavy drug and alcohol usage at the time of the incident will harm her credibility.

Charlie Sheen’s wife Brooke Mueller got help from the Aspen non-profit group Response, which assists victims of domestic violence, RadarOnline.com has confirmed.

Mueller, who told police she was assaulted by Sheen on Christmas Day, visited the group before going to court Monday to come-up with a “safety-plan” aimed at rebuilding the couple’s shattered relationship.

Formed in 1993, Response provides assistance for victims of domestic violence and sexual assault.
It states that its mission is: “To end interpersonal violence by providing support and direct services to survivors of domestic violence and / or sexual assault and to educate the community on related issues.”

A spokesperson for Response told RadarOnline.com: “I cannot speak about specific cases or people but we do have ‘safety plans’ which help couples who have experienced violence or other problems in their relationship.”
At Monday’s court appearance District Attorney Arnold Mordkin filed three charges against Sheen: felony menacing, third degree assault (a misdemeanor) and criminal mischief (also a misdemeanor).

Interestingly, Sheen wore his wedding ring while his wife did not, as the pair arrived and left separately from Pitkin County Court.
But it’s clear the couple has decided to stay together, even though multiple sources told RadarOnline.com they are miserable in their marriage.
Judge James Boyd agreed to modify the existing restraining order acknowledging that it was ‘her desire’ (Mueller) for him to do so.

But Judge Boyd left in some provisions of the order, prohibiting Sheen from intimidating or harassing Mueller. Sheen also cannot consume alcohol, illegal drugs or possess firearms; the actor was told he would be held in contempt of court if he breached any of these provisions.
Judge Boyd asked Mueller’s lawyer Yale Galanter if his client was comfortable with the “safety plan”.
He responded: “She is. She met with Response (a local organization for battered women) this morning. She is satisfied.”

Outside court Galanter added: “Brooke’s position is she would like the charges to be dismissed and the case to be over.
“What happens after today is anyone’s guess – we all need to let them get on with their lives.”
The lawyer also told reporters outside the court that the couple would start living together ‘right now’ and that he did not know why Mueller was not wearing her wedding band while Sheen was.

Sources have confirmed to Radar Online that Mueller has been staying at her mother’s home in Colorado and it’s expected that Sheen will stay with her at this house Monday night before they fly to Los Angeles together and try and rebuild their troubled marriage.
Mueller told police that Sheen held a knife to her throat on Christmas and threatened to kill her. Police discovered that Mueller had threatened to divorce Sheen and never let him see their infant twins.
Both had been drinking in the morning and both have been through rehab. Sources who know Charlie and Brooke tell RadarOnline.com that need is keeping them together.

“Charlie needs Brooke right now because if she turns on him she can send him to prison,” one source told RadarOnline.com. “And Brooke needs Charlie because without him she can’t live the lifestyle of a celebrity, plus she has a prenuptial agreement that won’t pay her a lot of money.”
Mueller hired Galanter to help her out of the situation. She doesn’t want to face charges of lying to the police but she also doesn’t want to send her husband to prison and cripple herself financially.

Mueller told police that Sheen threatened to killer her and held a knife to her throat as their argument escalated. Both had been drinking and had alcohol in their bodies at 8:30 am.

On Monday, lawyers for the couple requested that Judge James Boyd relax the protective order that prohibits any contact between them. That request was granted with the provision that Sheen stays away from owning or handling any firearms and does not consume alcohol. Sheen has been through rehab twice but has not publicly addressed the fact that he was drinking on Christmas when Brooke called 911. As RadarOnline.com exclusively reported, Sheen had a sober coach with him at the time, but consumed alcohol anyway.

Brooke recently left rehab treatment at Two Dreams Outer Banks in North Carolina. She flew to North Carolina after being hospitalized in Los Angeles for pneumonia. Her lawyer has denied that she was in rehab but multiple sources with direct knowledge of the situation have confirmed it to RadarOnline.com.

Meanwhile, Sheen's black Mercedes was stolen from his Los Angeles home on February 5 and then driven off of a nearby cliff on Mulholland Drive.
Mueller was not wearing her wedding ring in court Monday. Charlie was wearing his ring. Sources tell RadarOnline.com that Charlie is terrified Brooke will help prosecutors put him behind bars and Team Sheen has communicated that if that scenario unfolds Mueller will lose a lot of money, because she has a restrictive prenuptial agreement.

It was revealed in court that Mueller had attended Response, a battered women’s shelter in Aspen Colorado.
At the end of the hearing Charlie and Brooke hugged each other before leaving separately.

Two And A Half Men star Charlie Sheen will more than likely not appear in person at a hearing to decide whether his wife Brooke Mueller's temporary restraining order against him can be amended so that the couple can resume contact, RadarOnline.com has exclusively learned.
Sheen's attorney Richard Cummins filed a motion on January 5 to allow his client to testify via phone on January 5, and the motion was not opposed by District Attorney Arnold Moldkin.
"I don't care - she's (Mueller) not going to oppose it," Moldkin said.

Ultimately, it will be up to the judge to decide if Sheen can phone in, rather than personally be in the courtroom.
At this time, there's no date set for the hearing on the matter of the TRO (temporary restraining order), but it's expected that the hearing will take place prior to Sheen's arraignment on Monday, February 8 during which he is expected to enter a plea to charges connected with the incident.

Brooke Mueller’s celebrity lawyer Yale Galanter described his client’s alleged altercation with her husband Charlie Sheen as a ‘marital moment’ on Larry King Live Wednesday.
Talking live from Colorado, the high-powered lawyer, who previously represented O.J. Simpson, did his best to play down the incident that saw Sheen jailed after he allegedly held a knife to his wife’s throat.

Galanter claims that he is hopeful that there will be a ‘non-litigation’ resolution to the incident, and that he’s working with Sheen’s legal team to meet this goal.

As RadarOnline.com previously reported, Team Sheen has offered to add $1 million to her prenuptial agreement and told her if Sheen goes to prison over this incident there will be no money for Mueller.
