Court Papers Say Anna Nicole Smith’s Doctor Lied To Investigators About Medical Files

According to just released court papers tragic star Anna Nicole Smith’s doctor Sandeep Kapoor lied to investigators after they raided his Los Angeles home – by hiding her medical files below some shirts in his bedroom closet.
During a raid on his home on October 12, 2007, Dr Kapoor told Medical Board Investigator Jon Genens that he had no medical papers in his house and that they were being held at his attorney’s office.

But during the raid the investigators discovered some important papers about his famous patient whom he is charged with illegally prescribing medication to.
In court papers filed against Dr Kapoor Genens reveals: “Carmen Aguilera Marquez, Supervising Medical Board Investigator, found a file secreted on the floor of Dr Kapoor’s closet between some folded shirts.
“Inspector Marquez opened the file and saw the name Michelle Chase on a document which looked like a medical record – she closed the file because she believed the file may have contained medical records.

“Michelle Chase is an alias used by Anna Nicole Smith and the records were seized and sealed.
“When confronted Dr Sandeep Kapoor told me he had forgotten that he had that file of medical records, which we found secreted in the closet.
“Dr Kapoor told me that his attorney Ellyn Garofalo, told him to remove paperwork from the Anna Nicole Smith medical records and the paperwork we found in the closet, was the paperwork which his attorney had told him to remove.”

The papers also reveal that pharmacist Ira Freeman from the Key Pharmacy in Valley Village, California, confirmed that Smith was a patient under the care of Dr Kapoor and that Howard K Stern and her assistant Kim Walther regularly picked-up controlled substances and other prescription drugs for Anna Nicole Smith.
Psychiatrist Khristine Eroshevich and attorney Howard K. Stern have been charged with illegally providing Smith with prescribed drugs along with Dr Kapoor.

New court papers have revealed that the level of prescribed drugs being given to Anna Nicole Smith could have seriously harmed her unborn baby, RadarOnline.com can reveal.
Her doctor Sandeep Kapoor - who has been charged with illegally providing Smith with prescribed drugs along with psychiatrist Khristine Eroshevich and attorney Howard K. Stern – would not talk to RadarOnline.com at his Los Angeles surgery today.

Fortunately, Dannie Lynn Smith, now 3, is a healthy child but according to papers filed by Senior Medical Investigator Jon Genens, Kapoor was acting in a reckless fashion with his famous pregnant patient.
According to the papers prior to giving birth in September 2006 for nine months Kapoor had been prescribing her Methadone, Xanax, Ambien, Clonazepam, Dilaudid and Lorazepam.
Genens writes: “On Oct 9, 2007, Dr Jill Klesig (an independent medical expert) told me that benzodiazepines are associated with congenital malformations, miscarriages, neonatal dependence and lower birth weight, but the exact effect varies with the type of drug and what other drugs the mother was using.
“Dr Klesig told me there was a danger to the fetus from taking benzodiazepines but the risk must be weighed against the benefit of the mother taking the drug.”
The court papers also reveal that Dr Kappor was video taped with Smith in a nightclub type setting with his shirt off and his arm around her while kissing and nuzzling the Playboy pin-up’s neck.

The footage – which aired on Inside Edition on February 23, 2007 – showed that Dr Kapoor was not acting in a professional manner with his patient.
Genes notes: “On August 6, 2007, Dr Klesig told me that the standard of care for physicians is to maintain a professional relationship with his clients and that sexual contact is prohibited.
“Dr Klesig told me that Dr Kapoor’s physical contact on the video went beyond ant therapeutic touching and appeared sexual in nature – Dr Klesig told me this constitutes unprofessional conduct.”
Genens claims that Kapoor was over prescribing Anna Nicole Smith - real name Vicky Lynn Marshall - with a wide variety of drugs while she used the alias Michelle Chase for her prescriptions.
Dr Klesig agreed with Genens that from the period from April 2004 through September 2006 Smith was given potentially unsafe doses of Ambien, Clonazepam, Diazepam, Alprazolam, Lorazepam, Methadone, Klonopin, Valium, Xanax and Ativan.
Genens also claims that Kapoor over prescribed his patients Michael Arpaia, Steven Bauer, Robert Erb, Ramona Kimbrough, Claudia Martin, Brianne Morgan, David Panter, Jeff Trandos and Christian Volttz.
He writes: ‘In many instances Dr Kapoor has prescribed more than double the recommended dosages of controlled substances and he has prescribed large amounts of medications, sometimes prescribing with as little as one day between prescriptions.
“Some of the medications Dr Kapoor has prescribed would be lethal if the whole amounts were taken in the time period before the next refill of the medication – he seems to have a pattern of over prescribing drugs which could pose a potential danger to his patients.”
