Los Angeles Galaxy hunk David Beckham has filed an appeal in his $25 million dollar lawsuit against a magazine publisher and a Bosnian hooker, which was tossed out last year, RadarOnline.com is exclusively reporting.

Beckham’s lawsuit was dismissed in a California federal court, after the judge determined that In Touch Weekly's article titled David's Dangerous Betrayal, published on October 4, 2010, was in the public interest, and wasn't libelous.

David Beckham has filed an appeal to a Californian court in a dramatic bid to overturn another judge's decision to throw out his $25 million libel lawsuit  against a celebrity magazine over false claims he slept with a high-priced hooker.

"Notice is hereby given that Plaintiff and Cross-Defendant David Beckham hereby appears to the United States Court of Appeals for the Ninth Circuit," the terse two page court filing, obtained by RadarOnline.com, reads.

The appeal, which also named prostitute Irma Nici as a defendant, was filed around 11pm PT Wednesday.

A spokesman for the dad-of-three told RadarOnline.com, in an exclusive statement: "David is appealing both rulings and he is confident that justice will prevail."

David Beckham is being sued by Bauer Publishing over their legal costs stemming from a defamation lawsuit that the Los Angeles Galaxy star filed against In Touch Weekly claiming he had sex with a hooker.

On February 14, Judge Manuel Real dismissed Beckham's lawsuit against the publisher of the magazine, and now Bauer is seeking to recoup costs associated with the legal battle and RadarOnline.com has exclusively obtained the documents.

Bauer is seeking "an order compelling plaintiff David V. Beckham to reimburse Bauer for the attorney's fees and costs that it has incurred to defend against his meritless claims and to prepare this fee motion. This amount will include $256,386.95 in attorney's fees, $15,506.61 of computerized legal research and $7,712.97 in costs," the court documents state.

David Beckham is responding for the first time, exclusively to RadarOnline.com, to a federal judge’s decision to toss his massive $25 million lawsuit suit against In Touch over claims he slept with prostitute.

The soccer superstar, 35, has vowed to appeal Judge Manuel L. Real’s ruling and disprove publisher Bauer’s claims, as we first revealed.

Last year, Nici told InTouch magazine that she and Beckham had sex on several different occasions in 2007, one of which involved a second  prostitute. Beckham and his legal team immediately slammed the report, and in September filed a $25 million lawsuit against Nici and the magazine.

In the declaration, which is now part of Beckham's case file in the Los Angeles County Superior court, he provided a date-by-date account of where he actually was when Nici says she was with him.

On the first occasion, in August, 2007 when Nici claimed she having sex with the soccer stud, Beckham says he was in a different location, getting a pre-game rubdown!

As part of his regular routine when traveling with the Los Angeles Galaxy, Beckham says he'd always get a sports massage after checking into his hotel room the night before a game.

That's exactly what he was doing, Beckham says, when Nici said he was having sex with her.

"My security team was with me before, during and after the massage.  After the therapist left, I went to sleep," Beckham says int he declaration.

He also denied he'd had sex with Nici the following month at the Le Parker Meridien Hotel in New York.  Beckham insisted he's never even been in the hotel.

Money was also an issue in Nici's magazine story. She'd claimed Beckham parted with $10,000 for a threesome she set up with another prostitute. Not even possible insists Beckham, who says he does "not carry around thousands of dollars in cash when I travel."

Beckham, who is expecting his fourth child with wife Victoria, insists he never engaged in "unlawful acts of soliciting prostitution from Nici and another prostitute and of engaging in prostitution with them by paying for sex" at any time, or any place.

He's never met or spoken to Nici, he says.

The next hearing in the case in Feb. 7 in Los Angeles.

Judge Real rejected the request Monday, RadarOnline.com has learned, after Bauer's legal team argued In Touch Weekly's “report on Beckham's most recent extramarital affair... plainly involves Bauer's exercise of its free-speech rights about a matter of public interest.

Their superstar marriage maybe under the media spotlight right now, but Victoria Beckham claims her famous soccer husband David Beckham is "Godda**n perfect" in a new magazine interview, RadarOnline.com is reporting.

In the November, 2010 edition of Marie Claire Magazine, Victoria Beckham -- who poses in black slinky a corset on the cover -- gushes over her husband and dismisses any talk of a rift by saying, "We're still so close".

Irma Nici, the former hooker who is being sued by David Beckham for her published claim that they had a fling, is fighting back with her own lawsuit against the married soccer great, RadarOnline.com has learned.

According to her attorney, Nici filed her suit in Los Angeles County Superior Court Friday.

Represented by attorney Paul Rolf Jensen, Nici filed a special motion to strike Beckman's libel lawsuit.

"California law does not allow public figures like David Beckham to stifle free speech," Jensen says.  "Maybe he didn't live here in Los Angeles long enough to learn how precious we here consider our rights to tell the truth in print."

The sports superstar, married to singer-turned fashion designer Victoria Beckham, is also suing the magazine that printed Nici's allegations.

Nici's lawyer separately filed a cross-complaint for emotional and physical injuries he says she received when a process server showed up at her New York hotel with Beckham's lawsuit last week.  Her suit claims she was hounded until she had to leave the hotel.

"She was immediately hospitalized as a direct result of this event," Jensen says.  "Beckham is responsible for his goon's conduct, and we will hold him liable for it."

This latest legal action comes on top of revelations in a bizarre divorce case where a multi-millionaire lawyer claims his jewelry-designer wife was having an affair with Beckham.  Both she and Beckham fiercely deny the allegation.

The woman, Shery Shabani, is a friend of Victoria Beckham, the one-time Spice Girl who has three sons with Beckham.
