Indiana State Fair Stage Collapse Victims Get $5M Settlement

More than 45 people were injured and seven lost their lives when the stage collapsed in August at the Indiana State Fair, and RadarOnline.com has just learned the state will be paying out $5 million to the victims and their families.

Indiana Attorney General Greg Zoeller announced on Wednesday that the state plans to quickly distribute the money to the victims, which is the maximum amount allowed under Indiana’s government liability law.

As RadarOnline.com previously reported, 24-year-old cheerleading coach Meagan Toothman became the seventh death from the stage collapse when she was removed from life support by her family, so they could donate her organs.

The death toll from the Indiana State Fair stage collapse grew to seven Monday afternoon, when 24-year-old Cincinnati cheerleading coach Meagan Toothman was removed from life support, by her family’s request, for the purpose of organ donation, authorities said.

Toothman suffered injuries to her brain in the August 13 calamity, and had been in a medically-induced coma since August 15. She was taken off life support at Indianapolis’ Methodist Hospital Monday at around 3:30 pm CT.

As families of the victims of the stage collapse at the Indiana State Fair are still struggling to come to terms with the tragedy, others are preparing to fight back in court.

The first lawsuits were filed Friday by a Northwest Indiana law firm seeking tens of millions of dollars from the handful of companies that hosted the Sugarland concert at the Hoosier Lottery Grandstand, reports IndyStar.com.

The initial multimillion dollar lawsuits are on the behalf of Janeen Beth Urschel, 49, of Wanatah, Indiana, whose partner of ten years, Tammy VanDam, 42, was killed in the collapse as the couple attended the concert together.

Attorney Kenneth J. Allen explained that the filings are just a drop in the ocean in what will become an increasingly complex legal case.

"This was a terrible tragedy that could and should have been prevented. The responsible parties must be held to account," said Allen.

The attorney is seeking $50 million for VanDam's estate and $10 million plus punitive damages for Urschel from the numerous companies involved in the concert, which included Mid-America Sound Corp. of Greenfield, which owns the stage rigging structure; Live 360 Group, the show's Indianapolis-based booker; and Live Nation Entertainment, owner of Ticketmaster.

Along with lawsuits filed Friday, Allen also plans in the near future to challenge Indiana law's lack of recognition of a same-sex partner as a beneficiary under its wrongful-death law, and seek damages from the state for the victim's 17-year-old daughter.

As RadarOnline.com previously reported, the tragedy occurred during the Indiana State Fair on August 13 as thousands of fans were waiting to see Sugarland perform.

Five people were killed immediately.  A sixth victim, Jennifer Haskell, a student at Ball State University, died from her injuries on Friday.

The death toll from last week's Indiana State Fair grew to six Friday morning when Jennifer Haskell, a 22-year-old Ball State University student, died at an Indianapolis hospital, according to her uncle Mike Whited.

Haskell, who was majoring in sports medicine, suffered what would turn out to be fatal injuries when high winds of 60-70 mph caused a stage to collapse, killing six people and injuring more than 45 others.

With heavy hearts, the band played on.

Sugarland performed at Albuquerque, New Mexico’s Hard Rock Pavilion Thursday night – it was the duo’s first performance since high winds caused a stage to collapse at the Indiana State Fair, killing five people and injuring more than 45 others.

Taking the stage, the country duo of Jennifer Nettles and Kristian Bush called for a moment of silence for the injured "and the beautiful lives that were lost."

With heavy hearts, the band played on.

After a prayer to launch the service, Lt. Gov. Becky Skillman praised concertgoers who "set aside their personal concerns and moved toward the accident and not away."

Skillman said the best in people "is, and will continue, to be the silver lining in times of disaster."

The Indiana State Fair re-opens Monday with a public memorial service for the five people killed Saturday night, after high winds of 60 to 70 mph caused a concert stage to collapse, with an estimated 12,000 people in attendance to see the country music duo Sugarland perform.

The Indiana State Fair was rocked by tragedy Saturday night when a stage collapsed minutes before Sugarland was to perform - five are now confirmed dead.

Thousands of fans awaiting the superstar country duo had just seen opening act Sara Bareilles when an announcer warned of an impending storm.  Just-in-case evacuation instructions were given but everyone hoped the show could go on. Only moments later, the giant stage was practically lifted off the ground by high winds, and in what many eyewitnesses described as almost a "slow motion" sort of event, collapsed to the ground.

A VIP section called the Sugar Pit because of its position closest to the stage, was among the hardest hit as steel scaffolding pancaked.
