Gabriel Aubry, the father of Halle Berry's three year old daughter, Nahla, is telling close friends that he never pushed the nanny while she was holding the toddler, but that she tripped and fell, RadarOnline.com is exclusively reporting.

The Academy award winning actress and Aubry were in a Los Angeles courtroom Tuesday because she wanted a judge to strip Aubry of joint custody of Nahla, after he allegedly pushed their nanny, causing her to fall while holding the little girl.

However, Aubry is telling a very different version of events.

UPDATE: 9:39 a.m. PST - The hearing is over, and Halle Berry didn't say anything when it was over, but was smiling and looked very happy.

Halle Berry has just arrived at a Los Angeles courthouse to try and strip her baby daddy, Gabriel Aubry of custody of their daughter, Nahla, after he allegedly pushed their nanny, causing her to fall while holding the little girl, RadarOnline.com is reporting.

As RadarOnline.com previously reported, trouble started after the nanny showed up to pick Nahla up at school, and she was not there because Gabriel had kept her home sick for two days.

"The nanny went to pick Nahla up at school and she wasn't there, so she went to Gabriel's home," a source told RadarOnline.com. "Gabriel and the nanny got into an argument because no one alerted her that Nahla didn't go to school."

The same year she started a relationship with model Gabriel Aubry and the couple had a daughter together - Nahla who is now three.

Although their relationship ended, Halle recently found love again with French actor Olivier Martinez, who was spotted escorting his stunning girlfriend to a pre-birthday dinner Saturday at Mirabelle restaurant in West Hollywood.

The family of a two-year-old boy who plunged to his death during a Los Angeles Lakers basketball game is suing the owners of the Staples Center where the star-studded team plays, RadarOnline.com has learned.

The lawsuit filed on Tuesday at the Los Angeles Superior Court claims that Anschutz Entertainment Group (AEG) and L.A. Arena Co. failed to warn fans of the dangerous design of the luxury suites in the downtown L.A. stadium. The filing alleges wrongful death and negligence and the family is seeking unspecified damages, along with an injunction demanding taller barriers in the sky boxes at the sports center.
