Gary Giordano is “upset” and “concerned” in wake of a three-judge panel ruling Wednesday that he must remain in jail in Aruba until the end of October, despite not being charged with any wrongdoing in connection with the disappearance of Robyn Gardner, a Maryland woman he was traveling with on the Caribbean island.

In an exclusive interview with RadarOnline.com, Giordano's second wife, Connie Klein said that she hadn't yet heard the news that her former spouse was going to stay in jail for the foreseeable future.

"I didn't know that, this is the first I'm hearing about it," Klein, a real estate agent in Charlotte, North Carolina, told RadarOnline.com. "I have been in contact with him and spoken to him but not today so I have no comment about it," she said, but went on to say that her ex-husband was worried about the accusations against him when she last spoke to him in his Aruban cell.

A three-judge panel in Aruba ruled on Wednesday that Gary Giordano -- the prime suspect in the disappearance of missing Maryland woman Robyn Gardner -- will remain in jail until the end of October despite his appeal to be released.

Giordano appeared in court Wednesday to appeal his detainment, but his request fell on deaf ears.  (On August 31, a judge ruled that he must remain in jail for a further 60 days as the investigation continued).

A three-judge panel in Aruba ruled on Wednesday that Gary Giordano -- the prime suspect in the disappearance of missing Maryland woman Robyn Gardner -- will remain in jail until the end of October despite his appeal to be released.

Giordano appeared in court Wednesday to appeal his detainment, but his request fell on deaf ears.  (On August 31, a judge ruled that he must remain in jail for a further 60 days as the investigation continued).

While prosecutors admit that despite a mountain of circumstantial evidence, they still do not have the smoking gun to prove his guilt. However, they say there is more to come in the investigation and they argued they have enough to hold him.

There’s a chance -- just a chance  -- that Gary Giordano, the prime suspect in the disappearance of missing Maryland woman Robyn Gardner, could be released from jail today if a three-judge panel  approves his appeal of a judge’s order mandating that he be held until the end of October.

The issue is --  prosecutors say that despite a mountain of circumstantial evidence,  they still do not have the smoking gun to prove his guilt, reported Good Morning America.

As the concern over missing Maryland woman Robyn Gardner mounts, disturbing new details have emerged about prime suspect Gary Giodarno's behavior on the day of her disappearance.

According to the police report in Aruba, Giordarno had cuts on his throat and blood on his neck when he was on the beach after Robyn vanished.

"What I thought was strange was that this man was not searching...I also noticed that he had a scratch on his throat. It looked as if someone had scratched him with a nail," an eyewitness told the Aruban authorities, reported ABCNews.com.
