Lindsay's powerhouse attorney Shawn Holley formally notified the District Attorney and Judge Keith Schwartz on Wednesday that her client would not accept the plea deal, and although her team waited until the final hours to reject the offer, Dina said her daughter never even entertained the idea of copping a plea.

Lindsay Lohan has a secret plan to stay out of jail if Judge Stephanie Sauntner rules that she violated her probation for getting charged with felony grand theft, RadarOnline.com is exclusively reporting.

A source close to Lohan reveals: "Lindsay is taking a HUGE gamble by proceeding forward with the case. Her preliminary hearing is set for April 22, 2011. At the conclusion of the preliminary hearing, Judge Sautner will determine if there is enough evidence to proceed with a trial against Lindsay and if Lindsay violated terms of her probation.

Lindsay Lohan's attorney has formally notified Judge Keith Schwartz that she won't be taking the plea deal that would have included jail time in connection with her grand theft charge, RadarOnline.com can report.

Lohan had to notify Judge Schwartz by today about her decision.

Keith Middlebrook -- who owns Pro Sports Capital Management -- says his highly successful group of lawyers has cleared up the legal dramas of numerous top athletes in the past and he is willing to let them do the same for Lindsay.

"I have spoken to Lindsay for well over 30 hours and she is innocent," he told RadarOnline.com in an exclusive interview. "She checks in with me twice a day. And we will do everything we can to keep her out of
jail.

Judge Keith Schwartz has offered Lindsay Lohan 60-90 days in jail if the troubled actress pleads guilty to grand theft - but, Lohan is still balking at the deal and considering taking her chances at trial.

If Lohan doesn't agree to plead and she does go to trial and is convicted, she might not go to state prison though, being sent instead to the much ‘softer’ option of county jail,  a source close to the situation tell RadarOnline.com exclusively.

The Los Angeles District Attorney’s office believe they have a solid case against Lindsay Lohan if she does decide not to plea and instead to go to trial to answer felony grand theft charges, according to a source close to the situation.

In addition to the incriminating surveillance video in their possession, the DA’s office believe that Lohan arranging for an associate to turn over the alleged stolen necklace to cops “shows guilt”, the source tells RadarOnline.com exclusively.

The fact that Lindsay instructed them to return the necklace to the LAPD before a search warrant was executed at her house "proves that Lindsay stole the necklace,” the source says. “By having the necklace returned to the police, Lindsay basically admitted to cops that she was indeed in possession of the necklace. The DA will hammer this home if this case does not settle. There is absolutely no denying that Lindsay had the necklace."
