EXCLUSIVE INTERVIEW: Cop Who Clashed With Quaids Fired
Posted on Nov 18, 2009 @ 02:54PM - 2 comments

Former Presidio County, Texas, sheriff, James Davis, has been terminated for-- as yet-- undisclosed reasons, RadarOnline.com has confirmed exclusively.
On Wednesday, Davis’s attorney, Jason Snell, said he feels the sheriff’s department failed to follow the proper procedures when they fired Davis despite the department’s insistence that the termination had nothing to do with allegations made against him by Evi Quaid.
Evi Makes Battle With The Sheriff’s Office
Prior to him being fired, Davis had filed a lawsuit suing Evi for defamation of character. In September, Evi, who is married to actor Randy Quaid, accused Davis of taking money and illegal bribes in connection with their arrests on felony charges. She wrote out her claims on the side of a truck parked outside the mayor’s office.
“My gut tells me this had everything to do with Evi Quaid,” Snell told RadarOnline.com exclusively. “But at this point we have no way of knowing that for sure.”

Snell told RadarOnline.com that Davis still intends to move forward with his lawsuit.

“Evi is very good at evasion, but we are putting all of our energy into having her served. We won’t stop until we prosecute this lawsuit,” he said.

An arrest warrant for the pair had been dropped after they posted bail of $20,000 each. Prosecutor Lee Carter revealed that the warrant to extradite them back to Santa Barbara had been dropped after they had failed to appear in court three times.
However, Marfa Mayor Daniel Dunlap says the husband and wife are in hot water back in his town after Evi got in an argument with an administrator and removed papers from his City Hall.

Planning authorities had to place a cease and desist order on their property after they worked without the proper permits. Also, local Deputy James Davis has sued them for defamation after Evi painted the side of a truck and parked it outside Mayor Dunlap’s office accusing Davis of taking bribes.

Hughes, who lives in New York, exclusively told Radar Online.com: “We have contacted our lawyers and we are just waiting to see what happens. They are totally deluded because they think that part of the building belongs to them when it does not. The thrift store that operates in our building has lost a lot of business because they have taken-up all the parking spaces and they keep trying to intimidate people in the town. I do not know why they have behaved in this way but they have upset so many locals in Marfa for no real reason. We were hoping to move there one day but to have them as neighbors might be really difficult - legally we are monitoring what is going-on with our building.”

Randy and Evi Quaid really know how to up the ante when it comes to the crazy stakes.

Despite requesting the case to be put on calendar both Quaid's were once again a no show in court Monday in Santa Barbara.
There was confusion in the court as the judge and DA pondered alike why the Quaids would have requested the case to be put on calendar just to not turn up again.

Judge Clifford Anderson said, " The case was put back on calendar today when local counsel approached me with consent of Mr .Carter.
"But they are not here and so bench warrants remain out as they have since they were issued back in September. And this time we will not be putting case back on calendar until they definitely post bail or appear in person."

District Attorney Lee Carter seemed less than impressed with the Quaid's time wasting antics. "All bets are off," he said. "I received the phone call this morning that the case was on calendar. But they're not coming. They just can't seem to make it here."
Seems like a good point. In fact, according to the DA the Quaids are physically still in Texas, so there was never a chance of them showing in the first place!

And why are they so afraid of showing up in court? Santa Barbara Sheriff's Department Detective Rod Forney has a theory, "They're afraid to show up because they will be arrested," he tells RadarOnline.com in an exclusive interview. "And they're absolutely right. That's exactly what would happen. There's no telling what is going through their minds right now."
P.I. Says She Fears For Randy Quaid’s Life
One thing is for certain everyone involved in the Quaid fiasco appears to be getting pretty sick of their antics.
The DA for one is becoming more and more frustrated. An eyewitness at the court tells RadarOnline.com, "Lee Carter was on the phone with Evi and she was screaming and ranting at him. He spoke to her like someone calming down a mentally ill person. He just kept repeating the same thing over and over again. You can tell that he's really beginning to tire of all the drama.
"He advised her that if they come to California they need to contact a bail bondsman and an attorney because they will be arrested, no way around that."
