Those fun folks at E*TRADE who've created all those fun TV spots featuring chatty babies, are now letting you build your own talking message.
Here's the catch: there are two words that are not permitted to come out of the football helmet-wearing baby's mouth: "Lindsay" and "Milkaholic," RadarOnline.com is exclusively reporting.

Online financial giant E*Trade is fighting back against a lawsuit lodged by Lindsay Lohan that claims the company used her name and celebrity without her approval in one of their famous baby commercials that aired during the Vancouver Olympics and the Super Bowl.

"Plaintiff Lindsay Lohan filed this lawsuit because E*Trade aired a commercial featuring a baby that happened to share the same first name as her and over 250,000 other women and girls in the United States," said the papers filed by E*Trade with the Supreme Court of New York on April 30. "Plaintiff's claims are meritless and should be dismissed as a matter of law."

In the humorous video, the E*Trade Baby explains to his girlfriend via a webcam why he didn't return her call the night before. The girlfriend grills him about whether "that milkaholic Lindsay" had been over. The baby "Lindsay" then pops up on the E*Trade Baby's webcam asking, "Milk-a-what?"
On March 8, Lohan's legal team sued for fifty million dollars in damages saying the company used her "name, characterization, and personality" in the advertisements without her consent.

E*Trade fired back, pointing out that she simply isn't famous enough to be recognizable by her first name unlike some other celebrities who have taken legal steps to protect that identity.

"Although Plaintiff claims that she is well-known by the single name 'Lindsay,' celebrities who actually have achieved fame under one name, like Oprah, Madonna, Cher and Beyonce, have federally registered their names as trademarks thereby establishing the distinctiveness of their single names," the company's lawyers stated.

Not only has Lindsay not made attempts to trademark her name, she is barely recognized by her first name, the company claims. "The fact that the plaintiff is not known by her common first name is further demonstrated by media coverage, which refers to her as 'Lohan' or 'LiLo.'"

The company also points out other famous Lindsays like Olympic skier Lindsey Vonn, tennis player Lindsay Davenport, and actresses Lindsay Wagner and Lindsay Price. Furthermore, the company says, the "Lindsay" in the commercial is a baby while Lohan is a twenty three year old woman.

E*Trade may have sealed its own fate by filing hundreds of pages detailing Lindsay Lohan’s “personal problems” and stacks of nasty comments from detractors.
In an interview with RadarOnline.com, Michael Lohan called the documents “desperate” and “extremely unprofessional.”

“What the hell do these documents have to do with Lindsay’s lawsuit?” he told RadarOnline.com exclusively. “It seems E*Trades’ lawyers are grasping at straws now. They know they’re wrong and they’re desperate and they’re trying to convolute things.”
The actress, 23, is suing E*Trade for running a TV ad featuring a “milk-a-holic” baby named Lindsay, claiming the ad defames her character.

The documents, filed in Nassau County Supreme Court, detail Lindsay’s drug abuse, brushes with the law and club brawls along with reams of profanity-laced internet comments from the starlet’s detractors.
One commentor calls Lindsay “a pot-stirring, lazy, irresponsible, disrespectful little drama queen.”

“Why does anyone want to know what this trainwreck is doing?” Another adds. “She is the classic child star. A little success (parents pushed her into the business) at a young age and then she thinks she’s the poo.”

“How can she pay her rent and pay for her coke?” another comment reads.
“Why would they bring up Lindsay’s personal life if not to exploit her and her family? Michael told RadarOnline.com. “It surprises me that a company like E*Trade, which you would think has professional attorneys, is acting anything but by releasing these documents.”

A source close to Lohan told RadarOnline.com that E*Trade knew what they were doing when they filed the papers.
“This is what you call tainting the jury. You put all that out there for the public to see and it poisons the jury pool. It’s an invasion of the family’s privacy,” the insider said. “This is what companies do to make sure someone doesn’t get a fair trial. These people [E*Trade] released comments from regular people? Who cares? To attach that is an attempt to poison the jury pre-trial. That’s what big companies do.”
