Brian Oxman, attorney for Joe Jackson, appeared in a California Appellate court Wednesday afternoon to present arguments as to why his client should be allowed to challenge the administration of Michael Jackson’s estate.
At issue is the November 2009 decision made by Judge Mitchell Beckloff, ruling that Joe wasn't an heir or beneficiary of his late son’s estate because the pop icon intentionally left him out of his will and trust.

Michael Jackson’s ex-wife, and mother of his two eldest children, Debbie Rowe, is requesting her late husband’s estate pay for her legal fees pertaining to the guardianship of the kids, to the tune of $101,562.50.

Joe Jackson has taken one step forward in his quest to file a wrongful death suit following the passing of his superstar son last June.
In papers obtained by RadarOnline.com the Superior Court of California ruled on Friday that Joe be allowed access to Michael Jackson's medical records, something that the singer's Estate had fought against, citing physician-patient privilege.

The Judge ruled Joe is entitled to the records from UCLA on the day Michael died. The papers state, "While the court acknowledges that medical records are documents to which the right to privacy attaches, Michael Jackson's right of privacy does not apply under these facts because Michael Jackson is deceased."
Joe Jackson Requests Allowance From Michael Jackson Estate
According to Joe he needs access to the records as they are "necessary to evaluate his wrongful death claim for purposes of determining the likely cost of pursuing that action."
Dr. Conrad Murray Pleads Not Guilty - Bail Set At $75k
Joe says that the records will "provide the necessary foundation for evidence he will present at the family allowance hearing about his overall ongoing financial needs during the course of estate administration".
As RadarOnline.com previously reported Joe is requesting a monthly allowance from his late son's Estate, an evidenciary hearing is set for May 26th.

Howard Weitzman, the attorney representing John Branca and John McClain, Special Administrators for the Estate of the late superstar Michael Jackson, released a statement Monday following Dr. Conrad Murray’s appearance in court.

“Sadly, today’s events are a painful reminder of Michael’s untimely passing last June 25 and the deep personal loss we continue to share with his fans, his friends, and especially his family and children,” the statement says. “We hope justice will be done. During the years the world was blessed to have known him, Michael chose to use his gifts and artistry to give people hope, to comfort those in need and to spread messages of unity and peace. Because of that legacy he left behind, we believe that in years to come Michael will be remembered far more for the remarkable things he did with his life than for the tragedy of his death.”

Judge Schwartz also placed limitations on Murray's medical practice, ruling that he can't use or prescribe any anesthetic or Propofol. He also barred Murray from giving any heavy sedation meds. Murray can prescribe anxiety medications. The limitations are in place anywhere Murray is licensed to practice.

As RadarOnline.com previously reported Murray was arraigned Monday at LAX Court in Los Angeles and charged with involuntary manslaughter in connection with the the death of his former patient. Murray pleaded not guilty and was released on $75,000 bail.

Following the DA’s concerns that Murray may be a flight risk, Judge Keith Schwartz ruled that Murray's passport must be turned over, but didn't place travel restrictions within the US.

Murray is ordered to next appear in court on April 5th.
