Lindsay's lawyer Shawn Chapman Holley, is attempting to work out a deal without jail time but a source close to the situation tells us that's simply not going to happen.

Lindsay's attorney Shawn Chapman Holly met with prosecutor Danette Meyers on Monday and the result is at least another day of freedom -- and maybe more -- for Lindsay, sources close to the situation told RadarOnline.com exclusively.

Lindsay's attorney Shawn Chapman Holly met with prosecutor Danette Meyers on Monday and the result is at least another day of freedom -- and maybe more -- for Lindsay, sources close to the situation told RadarOnline.com exclusively.

Lindsay is being investigated for grand theft and is accused of stealing a $2,500 necklace from a Venice, California boutique. Erroneous reports during the weekend said she would be arrested Monday.

RadarOnline.com was first to report that Lindsay was under investigation and also that should would not be arrested Monday. Now we've learned it looks like her lawyer has bought her some more time.

"Lindsay's fate won't be decided for at least a day or more," one source close to the situation told RadarOnline.com exclusively. "The case is still under review, and Danette Meyers is still deciding what charges if any Lindsay will be facing.

"Lindsay's attorney, Shawn Chapman Holley had a very productive meeting with Meyers. Shawn had to leave town overnight (Monday) for business, and it's unlikely that Danette would charge Lindsay while Shawn was out of town. Shawn will be back in town tomorrow (Tuesday) night."

It's even possible that Lohan's powerhouse attorney was able to sway Meyers into NOT charging Lindsay. "Lindsay has a legit explanation, she was loaned the necklace, this happens all the time in the celebrity world," a source told RadarOnline.com.

"Remember, Shawn was part of the 'Dream Team' that got O.J. Simpson acquitted of murder charges. Shawn is tops in what she does. If there is anyone that can get Lindsay out of this mess, it's Shawn," another source said.

Shawn Chapman Holley issued a statement during the weekend about the theft allegations against her client, "We vehemently deny these allegations and, if charges are filed, we will fight them in court, not in the press."

Lohan had an associate return the necklace after reading RadarOnline.com's report that police had obtained a search warrant for her home. The fact she turned it in does not change anything in the legal case.

Danette Meyers, the prosecutor in Lindsay’s case, told RadarOnline.com that Lindsay most likely will be free before spending her entire 90 day sentence in rehab at UCLA Medical Center.

“My understanding from conversations with Shawn Chapman Holley is that Miss Lohan could be released early from the treatment facility,” Meyers told RadarOnline.com exclusively.  “It is looking as if that is what the health care professionals are going to recommend.

“How much earlier she could be released I’m unsure of at this point.

“I will follow what the health care professional advise. That could involve follow up treatment for Miss Lohan, however, it is my understanding that it is looking like the health care professionals will be recommending that she be released earlier than the 90 days Judge Revel previously ordered.”

Judge Marsha Revel sentenced Lindsay to jail and rehab but recently recused herself from the case.

Lindsay’s attorney Shawn Chapman Holley told RadarOnline.com on Wednesday that the actress looks healthy and can’t wait to return to work.

Holley told RadarOnline.com: "Ms. Lohan looks very good. She looks healthy. My client is looking forward to returning to work on her many creative endeavors upon her release from the treatment facility."

RadarOnline.com broke the news last week that Judge Revel, Shawn Chapman Holley, Lilo's powerhouse attorney and Danette Meyers, the deputy district attorney handling the case, held a top secret meeting to discuss Lindsay's case.

The meeting was characterized as "productive" we are told, and all parties have been communicating.
