As previously reported, the Department of Children & Family Services found no basis to the claims that Aubry has ever physically, or emotionally abused the warring couple’s daughter, Nahla.

The Department of Children and Family Services has recommended that the investigation of Gabriel following claims he was mistreating his daughter Nahla be dropped after a thorough review that revealed there was no basis for the claims, RadarOnline.com is exclusively reporting.

A judge in the dependency court is currently reviewing the recommendations from DCFS with Aubry and his attorneys.

As RadarOnline.com previously reported the former couple squared off in a Los Angeles courtroom on Monday over allegations that Aubry pushed the nanny while holding the toddler. The hunky Canadian model has emphatically denied the allegations, but is under criminal investigation for battery and child endangerment.

As pictures emerged of a disheveled Brooke Mueller appearing to be holding a tin foil crack pipe, and reports of an apparent drug relapse surface, she still retains custody of her twin boys from Charlie Sheen.

In addition, RadarOnline.com has exclusively learned why child protective services haven't visited Mueller or opened an investigation into her sons' welfare.

"The reason that DCFS haven't visited Brooke Mueller's home, to check on the boys, is because the department hasn't been called to do so, as simple as that," a source with knowledge of the situation tells RadarOnline.com. "DCFS can't just show up at someone's house and demand to interview the parents and children. DCFS goes out when a call has been made to alert the department about a concern involving a child, and that hasn't been in this situation."

Sheena Upton, who shot to overnight infamy after purportedly injecting Botox into her eight-year-old daughter, is taking parenting classes and undergoing mental health counseling, RadarOnline.com has exclusively learned.

Upton and her two daughters, along with several other family members, visited with social workers from the Los Angeles Department of Children and Family Services earlier this week.

The visit took place at the offices of DCFS after Upton became concerned that the media would stake out her house if the visit occurred there.
