Attorneys representing David Letterman and the late night host's accused extortionist went head-to-head on Wednesday's edition of The Early Show, a day after a judge said he would decide whether or not to throw out the case early next year.
Gerald Shargel, who is representing CBS news producer Robert "Joe" Halderman, said his client was merely trying to execute a "legitimate business transaction" in selling a screenplay to Letterman. Letterman’s attorney Daniel Horvitz disagreed, saying Letterman was "absolutely" ready to take the stand against the man he said was trying to blackmail him.

David Letterman's accused extortionist, CBS news producer Robert J. "Joe" Halderman, will appear in a New York courtroom Tuesday in hopes of getting the grand larceny charge levied against him dismissed.
The first step in the process will be challenging the validity of the evidence presented to the grand jury, according to Halderman's attorney, Gerald Shargel.

The papers say that on September 9th Detective Pasquariello was contacted by James Jackoway and informed that one of his clients, a public figure, received a package from Robert Joe Halderman, AKA Joe Halderman, containing a demand letter, a treatment for a screenplay and supporting materials, including copies of portions of a diary and personal correspondence belonging to [name omitted], telephone records and photos.
Letterman Apologizes To Wife While Taping Show
In the letter Halderman states that he needs to "make a large chunk of money" by selling the client the so-called screenplay treatment.
The letter then describes that the client's "world is about to collapse around him" as information about his private life is exposed, leading to a "ruined reputation" and severe damage to his career and family life.
Halderman Lived With Woman That Was Sleeping With Letterman
On September 15th Jackoway met with Halderman to discuss the demand for payment. Halderman stated in substance that he demanded $2million to ensure the information in the screenplay treatment and supporting materials would not be made public. They met a further two times and the meetings were recorded by the New York County District Attorney's Office Detective Squad.

According to the Norwalk Police Department evidence log, items seized included banking materials, suspect/attorney agreement, a magazine featuring an article on David Letterman, A Halderman paycheck, photograph, computer, disks, zip drive, video and audio tapes, external hard drive, printer, camera memory card and photo copy of IDs.
