Gossip Girl's Kelly Rutherford has reached a divorce settlement with her estranged husband ending a bitter custody battle, and RadarOnline.com has the latest drama from the courtroom.

On Wednesday afternoon, the 41-year-old beauty was granted a request to take her two children to New York with her. A relieved Rutherford told RadarOnline.com “We will be staying in Los Angeles until June, when I go to New York City to film Gossip Girl and the children will be going with me.”
However, Judge Teresa Beaudet ruled Rutherford and her estranged husband 35-year-old Daniel Giersch must attend co-parenting classes weekly.

After Rutherford's lawyer said her 3-year-old son was having emotional issues at his private pre-school, Hermes was ordered to meet with a pediatric therapist within the next two weeks. And, Hermes must attend pre-school in Los Angeles, unless the therapist thinks it would be better for him to be at home with his parents.

At the end of the proceedings, Financier Daniel Giersch told RadarOnline.com “Today was a great day for two young children. I got an improved faster step up plan with my daughter. The custody with my son stays in place. Los Angeles is the home of the children.”
The couple has been feuding for months, but on Wednesday Rutherford dropped a restraining order against Giersch, who said his estranged wife “admitted that obviously all accusations were fabricated. She has done so by dropping the whole case just a minute before she was ordered to show proof.”
Both Rutherford and Giersch waived their respective rights for spousal support. Child support and property issues were also resolved.

After the extremely efficient day in court, Judge Beaudet set a trial date for custody issues only for June 2nd, 2011.

Kelly Rutherford and estranged husband Daniel Giersch faced off in court on Wednesday in Santa Monica, Calif., over the temporary restraining order she had placed on him. To their surprise, the battling couple got a tongue lashing from judge Teresa A. Beaudet.

"You could have called at 4:30 yesterday and let me know [they wanted the continuance]," Beaudet said admonishing the couple. "I am new with the case so I spent hours last night familiarizing myself with it. But worse than my inconvenience, every time we call a court case up to be heard, it costs the court a lot of money and this has been going on since September."

Despite feeling that the couple was wasting the court's time and money, Beaudet granted the continuance and scheduled another hearing for April 7 barring a medical emergency or an out of court resolution through mediation.
While the judge asked to throw out the restraining order and just agree to do curbside pickup, Rutherford's lawyers said that would not work since Giersch has allegedly violated the restraining order already. Her lawyers also scoffed at the idea of a mutual stay away order saying Rutherford had done nothing to merit one. Rutherford is seeking that the temporary restraining order be made permanent.
Rutherford spoke to RadarOnline.com outside the courtroom and confirmed that despite the divorce drama, their children Hermes and Helena are hanging in there. "They are doing great! Really good," Rutherford said. Despite a recent bout of the flu, her daughter is "all better."

Kelly Rutherford has filed legal paperwork for her temporary restraining order hearing against her estranged husband, Daniel Giersch, which will take place Wednesday in a Santa Monica courtroom.

The documents are formally requesting testimony be given by Kelly along with her present and former nanny. The documents also state that Giersch is anticipated to testify.

Rutherford's mother, Ann Edwards will also be testifying about her interactions with Giersh which prompted Rutherford to seek a restraining order. Kelly alleges that Giersch has been harassing her, her mother and caretakers.
Kelly Steps Out Post Baby
Giersh is firing back at Rutherford, among his claims, Giersch asserts he wasn't given make-up time to visit with their daughter Helena who was sick with the Swine Flu at Kelly's home.
Giersch says in his declaration, "Thus far, Kelly has only provided me 3 days of make up time with Helena.....This does not include my two custodial days where Helena had the swine flu, and for which she has promised make up time."
Giersch says he never harassed or threatened Kelly or any of the nannies.
As RadarOnline.com previously reported Giersch and Rutherford have been embroiled in a nasty custody battle over their two children, Hermes, 3, and Helena, 7 months old since they split.
Things have gotten so bad between the two that Giersch wasn't even present at the birth of Helena, Rutherford opted, instead, to have her mom present in the delivery room.
Giersch and Rutherford were married in August 2006, Rutherford filed for divorce in December 2008, Giersch filed for legal separation on the same day.

In documents filed at the Los Angeles County Superior Court Rutherford claims Giersch has repeatedly harassed her, her mother and their children's nanny.

The two have been embroiled in a nasty divorce with Giersch making claims that Rutherford is violent and an unsuitable mother to their son Hermes and new born daughter, Helena Grace.

Now Kelly is firing back, claiming "Daniel has begun to follow me, my mother, my nanny and he shows up unexpectedly to threaten and scare us."
The actress also claims Giersch " has harassed [my nanny] with questions about me virtually every time he sees her ... last week Daniel's harassment of [the nanny] led to an actual threat that he is going to file a lawsuit against her."
Kelly claims the harassment got so bad that the nanny quit, meaning their two kids lost someone they "love and trust."
In the TRO Giersch is ordered to stay 100 yards away from Kelly, her mother, and the nanny "except for brief and peaceful contact as required for court ordered visitation."

Kelly Rutherford and her ex-husband Daniel Giersch are seemingly at the end of their heated court battle over their two children. On Monday, they reached a settlement that will make the entire family relocated to the east coast, something a source tells RadarOnline.com will be a “hassle.”

“Kelly has just packed her bags and kiddies and flew to New York city to film Gossip Girl,” the source said. “Daniel ended up having to get his own place as well and it’s becoming a big hassle for them all.”
Per their agreement, “both parties will temporarily relocate from the state of California to New York during the season of respondent filming the television series Gossip Girl from July 30, 2009 to April 5, 2010.” The couple were ordered to attend co-parent counseling sessions and will share joint legal and physical custody of their two children Hermes and Helena.
Hermes will attend Lycee Francais New York for preschool while Rutherford films. Once the show is wrapped, he will move to the Los Angeles branch of the school. Rutherford and Giersch will equally divide the tuition and related costs.

Perhaps Kelly Rutherford saw the writing on the wall, given her preemptive strike to ban soon-to-be ex-husband Daniel Giersch from leaving the country with the couple's children.
RadarOnline.com has learned that Giersch, a German businessman, has been teaching his son his native tongue.
"Daniel has been teaching Hermes german," a source close to the situation reveals.
While it seems like a normal tradition for parenting on the International level, it turns out that Daniel isn't exactly resting his laurels in U.S. soil.
"Daniel thought he was still going to become a citizen through his marriage to Kelly, but that [isn't] happening because they weren't married long enough for him to get his greencard," the source reveals.
In court documents filed yesterday, Rutherford indicated fears that Giersch will up and take two-year-old Hermes and newborn Helena back to Deutschland.
She and her attorney are requesting the surrender of Giersch's visa and a pending application for a visa.

As RadarOnline.com reported, Kelly Rutherford had her mother at her side during the birth of her second child Helena, rather than her estranged husband Daniel Giersch. While sources close to Rutherford are said to be fuming that Giersch has yet to visit his new baby girl, he fights back against the claims and reveals he is in the midst of negotiating how often he is allowed to visit the hospital.

"We are currently negotiating how often I am allowed to go to the hospital. The only thing the judge said in court last time is that I can see my daughter three times a week for one hour," he told BUNTE magazine. "I am happy that Helena was born and I hope both are doing fine but I did not know anything although we agreed that I would get a call or a text message as soon as she goes into labor."
He claims Rutherford's lawyer only informed him of the birth on Tuesday morning at 8:45 am and also mentioned how his son was left at home, thus violating a pre-existing agreement.
“Kelly is not allowed to stay away from Hermès more than three hours. If that's the case she has to call me so I can take care of him.That's what the judge said," Giersch explained. "Now Hermès is afraid because his mom is not in the house when he wakes up in the morning."
Giersch's mother is also in L.A. to support her son.
