Giersch's lawyer, Fahi Takesh tells RadarOnline.com, "These fabricated accusations are intended to harm Daniel's reputation. Gossip Girl mom, Kelly Rutherford, has been issued a restraining order against her ex husband Daniel Giersch.

In documents filed at the Los Angeles County Superior Court Rutherford claims Giersch has repeatedly harassed her, her mother and their children's nanny.

The two have been embroiled in a nasty divorce with Giersch making claims that Rutherford is violent and an unsuitable mother to their son Hermes and new born daughter, Helena Grace.

Now Kelly is firing back, claiming "Daniel has begun to follow me, my mother, my nanny and he shows up unexpectedly to threaten and scare us."
The actress also claims Giersch " has harassed [my nanny] with questions about me virtually every time he sees her ... last week Daniel's harassment of [the nanny] led to an actual threat that he is going to file a lawsuit against her."
Kelly claims the harassment got so bad that the nanny quit, meaning their two kids lost someone they "love and trust."
In the TRO Giersch is ordered to stay 100 yards away from Kelly, her mother, and the nanny "except for brief and peaceful contact as required for court ordered visitation."

Kelly Rutherford and her ex-husband Daniel Giersch are seemingly at the end of their heated court battle over their two children. On Monday, they reached a settlement that will make the entire family relocated to the east coast, something a source tells RadarOnline.com will be a “hassle.”

“Kelly has just packed her bags and kiddies and flew to New York city to film Gossip Girl,” the source said. “Daniel ended up having to get his own place as well and it’s becoming a big hassle for them all.”
Per their agreement, “both parties will temporarily relocate from the state of California to New York during the season of respondent filming the television series Gossip Girl from July 30, 2009 to April 5, 2010.” The couple were ordered to attend co-parent counseling sessions and will share joint legal and physical custody of their two children Hermes and Helena.
Hermes will attend Lycee Francais New York for preschool while Rutherford films. Once the show is wrapped, he will move to the Los Angeles branch of the school. Rutherford and Giersch will equally divide the tuition and related costs.

Embattled actress and mother Kelly Rutherford made a public appearance on Friday, her first since the birth of her baby girl Helena.
Rutherford and son Hermes attended swanky baby boutique Bel Bambini's VIP reception in Beverly Hills, Ca.
The Gossip Girl actress is currently steeped in a divorce and custody battle with her ex-husband, financier Daniel Giersch. The couple currently share custody of Helena and two-year-old Hermes.

Perhaps Kelly Rutherford saw the writing on the wall, given her preemptive strike to ban soon-to-be ex-husband Daniel Giersch from leaving the country with the couple's children.
RadarOnline.com has learned that Giersch, a German businessman, has been teaching his son his native tongue.
"Daniel has been teaching Hermes german," a source close to the situation reveals.
While it seems like a normal tradition for parenting on the International level, it turns out that Daniel isn't exactly resting his laurels in U.S. soil.
"Daniel thought he was still going to become a citizen through his marriage to Kelly, but that [isn't] happening because they weren't married long enough for him to get his greencard," the source reveals.
In court documents filed yesterday, Rutherford indicated fears that Giersch will up and take two-year-old Hermes and newborn Helena back to Deutschland.
She and her attorney are requesting the surrender of Giersch's visa and a pending application for a visa.

As RadarOnline.com reported, Kelly Rutherford had her mother at her side during the birth of her second child Helena, rather than her estranged husband Daniel Giersch. While sources close to Rutherford are said to be fuming that Giersch has yet to visit his new baby girl, he fights back against the claims and reveals he is in the midst of negotiating how often he is allowed to visit the hospital.

"We are currently negotiating how often I am allowed to go to the hospital. The only thing the judge said in court last time is that I can see my daughter three times a week for one hour," he told BUNTE magazine. "I am happy that Helena was born and I hope both are doing fine but I did not know anything although we agreed that I would get a call or a text message as soon as she goes into labor."
He claims Rutherford's lawyer only informed him of the birth on Tuesday morning at 8:45 am and also mentioned how his son was left at home, thus violating a pre-existing agreement.
“Kelly is not allowed to stay away from Hermès more than three hours. If that's the case she has to call me so I can take care of him.That's what the judge said," Giersch explained. "Now Hermès is afraid because his mom is not in the house when he wakes up in the morning."
Giersch's mother is also in L.A. to support her son.

Kelly Rutherford gave birth to daughter Helena on Monday night with her own mother by her side in the delivery room at Cedars-Sinai Medical Center, RadarOnline.com has learned exclusively.
Helena is the second child for the Gossip Girl star, who has a two-year-old son, Hermes. She is divorcing Daniel Giersch, the father of both children.
RadarOnline.com broke the story Monday night that Kelly had given birth.
Now we've learned that people close to the situation are furious with Daniel, who has not been to the hospital to see his new daughter. While Kelly and Daniel are going through an acrimonious divorce she still invited him to see the baby but he had not shown up by late Monday morning.
Baby Helena has a full head of hair, our sources tell us and Kelly is doing so well she may go home Tuesday!

Congratulations, Kelly Rutherford! The actress has given birth to a baby girl, RadarOnline.com has learned exclusively.
The Gossip Girl star's second child was born at 10 p.m. Monday, via natural childbirth, in Los Angeles. She joins 2-year-old brother Hermes.
RadarOnline.com has learned that the father of both children, and Kelly's soon-to-be ex, Daniel Giersch was not present for the occasion.
Rutherford filed for divorce from businessman Giersch just before the new year, noting "irreconcilable differences."

RadarOnline.com caught up with actress Kelly Rutherford in Santa Monica, CA on Friday, nearly nine months pregnant and entrenched in a bitter divorce battle with ex Daniel Giersch.
"I've tried everything, I've tried mediation. I don't think he wants it to be amicable," Rutherford said exiting proceedings regarding their son Hermes.
The pair are actually arguing over the potty training regime for their 2-and-a-half year old, the issue winding up in court because Rutherford wanted Hermes' potty training to stop during their stressful split.
It was agreed that Hermes will continue to wear training diapers and be encouraged to go to the potty, if he so desires.
"He doesn't care," Rutherford said of Giersch, "he doesn't care if it's stressful, that's what's hard. What are you going to do?"
The Gossip Girl actress rattled off a few suggestions we found interesting. She contemplated outloud ways of coping with the messy situation.
"You write a book about it? You talk about it? You help other women, I guess, who have been through it?" she asked.
Rutherford is expected to deliver she and Giersch's second child, a girl, within the next two weeks.
The two will continue to share joint custody of Hermes, but will show to court for evaluation July 23. Rutherford is expected to return to Gossip Girl's NYC set on July 30.
