DDA To Judge Saunter - Lohan's Theft Case Shouldn't Have Been Reduced From Felony To Misdemeanor

Deputy District Attorney Danette Meyers, who has handled the bulk of Lindsay Lohan's legal woes, tells RadarOnline.com exclusively that Judge Stephanie Sautner should never have reduced the grand theft case from a felony to a misdemeanor.

"Had Judge Sautner kept the felony and not reduced the charge to a misdemeanor, Lindsay Lohan, once remanded would have been remanded without bail. That was the importance of keeping that a felony and not reducing it to a misdemeanor," Meyers revealed during Radar Live on Wednesday.

Meyers was assigned to Lindsay's two DUI cases, and subsequent grand theft case, and says, "You need to catch Ms. Lohan's attention and Judge Sautner didn't seem to want to do that, so she reduced it to a misdemeanor."

What does embattled Dr. Conrad Murray have in common with troubled starlet Lindsay Lohan?

Both were accused of crimes, and both, it turns out, weren’t charged with serious felonies. Dr. Murray is facing felony involuntary manslaughter, which under California law, isn't considered a serious felony, and is in the same realm as grand theft felony, which Lohan was charged with earlier this year.

Former Deputy District Attorney Hamid Towfigh revealed on Radar Live on Friday that "under California law, involuntary manslaughter isn't even considered a serious felony. It's in the same realm of offenses as grand theft, narcotics possessions, what have you, and Conrad Murray, even if the D.A. is successful in this prosecution, is gonna face the same amount of time that Lindsay Lohan was facing in the shoplifting incident. She was facing three years, he is facing four years."

Lindsay Lohan may be back home under house arrest at her rented posh townhome in Venice Beach, CA. Friday, but the controversy lingers over her dirty alcohol test -- the DA's Office is not happy the actress got off scot free in court Thursday.

As RadarOnline.com previously reported, Lohan, 25, dodged a major bullet in court when Los Angeles Judge Stephanie Sautner ruled that she believed the terms of probation set by Lohan's DUI judge had NOT been violated.

Judge Sautner determined that a previous judge in the case, Judge Eden Fox, did NOT indicate Lohan should be tested for alcohol in his order, only 'controlled substances'.

All of the evidence points towards Casey Anthony,” Meyers says. “The defense, they have to put her on the stand in order to prove what they were going to prove in opening statements without the father admitting that he molested his daughter, without the father admitting that Caylee drowned in the pool, the only other witness to that is Casey Anthony, and if she doesn't take the stand, I don't know what they argue, because the circumstantial evidence is overwhelming.”
