First Lie: Spencer is blackmailing Heidi so he can release a sex tape of her. 

Multiple legal experts have confirmed to RadarOnline.com that all parties involved in a sex tape must consent to the release or else it is a slam-dunk lawsuit for the party that didn’t consent. If the tape is released, the party who hasn’t agreed can sue for invasion of privacy and a host of other legal issues. And they are nearly guaranteed of a huge court victory.

That’s the dirty little secret with celebrity sex tapes – the celebrity has to agree to its release and they always profit off the sales. Paris Hilton still gets a cut of her tape’s profits as does Kendra Wilkinson. Kim Kardashian settled for $5 million after dropping her lawsuit against Vivid Entertainment.

So without Heidi’s consent Spencer can’t release the tapes.

Heidi Montag is nowhere near Costa Rica and has no idea why Spencer Pratt might be spreading rumors that the two are there meeting, as has been reported elsewhere.

"She is not in Costa Rica with Spencer," Cougar says.  "She does not know why he is saying this."

Rumors were spreading Saturday that Heidi and Spencer were meeting in Costa Rica to discuss whether their alleged sex tape would be released or if they should do another reality show together.

It's just not true, Zank insists.

Heidi, who has filed for divorce from Spencer, also suspects her estranged husband may be in Costa Rica with a blonde look-alike.

Shortly after the news broke that Spencer Pratt was shopping around an alleged sex tape with estranged wife Heidi Montag, friends of the buxom blonde quickly spoke up on her behalf regarding the potentially embarrassing situation.

“Heidi’s really p---ed off,” the couple’s pal Cougar Zank told RadarOnline.com.  “She denies there is a sex tap. She’s furious that Spencer would try and embarrass her like this.”

Cougar spoke to Steven Hirsch from porn distributor Vivid who confirmed that Spencer just tried to shop the tape but they have yet to see it.

When asked if Heidi knew about Spencer’s plans, her pal Jennifer Bunney told RadarOnline.com: “No way [Heidi know about this].

“She would never put out a sex tape of herself. She’s extremely religious and concentrated on getting her life to where she wants it to be.”

A sex tape, Bunney says, is the “last thing” Heidi would do.

Despite Hirsch’s claims about his conversations and negotiations with Pratt, Bunney is hopeful it is all a misunderstanding.

“Really, Spencer would never hurt Heidi. He loves her even despite the fact that they are getting a divorce. I really doubt the validity of this.”

Though Spencer Pratt and Heidi Montag’s friend Cougar Zank said the couple’s split was “a show,” the reality star is speaking out through her longtime pal Jennifer Bunney about moving forward with the divorce proceedings.

“I talked to Heidi and she wants people to know that Cougar doesn’t know what he’s talking about,” Bunney told RadarOnline.com exclusively. Bunney says that while Spencer and Heidi are “amicable,” their divorce will proceed.

“The only thing they have to work out is the custody of their dogs since they have four dogs together.”

Bunney also revealed that Heidi is moving out of the Malibu home that both Cougar and Spencer have been spotted at.

“The house’s lease is over and Heidi is moving out,” she said. As for the men in Heidi’s life, Bunney says that for now, “Spencer and Cougar are living together in a separate house.”

Though Bunney would happily move in with Heidi (which was their original plan at the beginning of the summer), she understands that Montag simply “wants a break from everything.”

Bunney adds that Heidi’s recent seclusion from the public eye is strategic. “She wants to make sure she is healthy in every way possible before she gets back in the media,” Bunney added. “She wants to ground herself.”

While Heidi “wants a break from reality television,” Bunney says the former Hills star is “really interested in movies.”

Heidi Montag has gone into hiding, refusing to talk to longtime friends and family including pal Jennifer Bunney and dad Bill Montag. Bill told RadarOnline.com that he wants to take a trip to Los Angeles to face his daughter.

“I still haven’t heard anything from my daughter so I don’t know what is going on with her,” he told RadarOnline.com.

“I need to go out there and visit her and I will.”

Bill, who works as a rancher in Colorado, recently suffered a serious bacterial infection. He has recovered but revealed that he has yet to speak with Heidi who did not reach out to him during his illness. In fact, the last time they spoke was in March.

For right now, he’s hoping to get to know “more about what’s going on and more facts” before drawing any conclusions about Heidi’s life.

Recently, Bunney spoke to RadarOnline.com explaining Heidi’s lack of communication and why The Hills star backed out of the reality television show they were planning on doing.  “She’s just going through so much with her divorce and she just doesn’t want to do reality television,” Bunney said.  “This is kind of what she has to do- with a the divorce and The Hills ending- a lot is new in her life and she’s not talking to anyone.” Though Bunney has always liked Heidi’s current beau Cougar Zank, she’s beginning to question some of his actions.

“She’s going through a lot but I don’t understand why Cougar doesn’t call or say how Heidi is. I’ve been her friend for years, before she got famous, before the surgeries, before Spencer...Heidi doesn’t even know that I broke up with my boyfriend.”
