Charlie Sheen and Brooke Mueller's twin boys Bob and Max are being raised by their grandmother and have not seen their wayward father in nearly a month, RadarOnline.com is exclusively reporting.

Mom Brooke checked into an undisclosed rehab center last week and is expected to remain in treatment for at least the next 60 days. However, despite her absence, Charlie hasn't asked to spend any time with his two-year-old boys.

"Charlie last saw the boys about three weeks ago," a source close to the situation tells RadarOnline.com. "He hasn't requested to see the boys more now that Brooke is in rehab.

As pictures emerged of a disheveled Brooke Mueller appearing to be holding a tin foil crack pipe, and reports of an apparent drug relapse surface, she still retains custody of her twin boys from Charlie Sheen.

In addition, RadarOnline.com has exclusively learned why child protective services haven't visited Mueller or opened an investigation into her sons' welfare.

"The reason that DCFS haven't visited Brooke Mueller's home, to check on the boys, is because the department hasn't been called to do so, as simple as that," a source with knowledge of the situation tells RadarOnline.com. "DCFS can't just show up at someone's house and demand to interview the parents and children. DCFS goes out when a call has been made to alert the department about a concern involving a child, and that hasn't been in this situation."

Charlie Sheen's ex-wife, Brooke Mueller has successfully finished rehab, RadarOnline.com is exclusively reporting. Mueller had been enrolled in a 45-day outpatient treatment program, that allowed her to spend the evenings with her twin sons Bob and Max.

“Brooke is just taking it a day at a time,” a source close to the situation says. “She has been down this road before and she knows what she has to do. Brooke needs to continue to play an active role in her sobriety. When she goes to her AA meetings everyday and talks regularly with her sponsor, she does amazing.”

Battling exes Charlie Sheen and Brooke Mueller are scheduled to be in family court June 9 for the latest round in their custody battle over their twin sons Bob and Max.

But, a source close to the situation tells RadarOnline.com exclusively that the warring couple are putting their differences aside, for now, to work hard at reaching a settlement ahead of the date.

"Brooke and Charlie's attorneys are confident that a settlement can be reached before June 9, and its almost a done deal,” the insider reveals. “There are a few very minor details to work out, but both sides are expected to tell the judge that the matter has been settled ahead of time.”

Brooke Mueller was all smiles earlier this week when a Los Angeles judge denied Charlie Sheen’s request for full custody of the estranged couple’s twin sons.

However, friends of Mueller’s are concerned the decision will be detrimental to the struggling addict’s stab at sobriety and that she may have had a better chance at recovery if she had actually had the boys taken away.

“We are fearful that Brooke will never truly get sober until she hits rock bottom,” a close friend of Brooke’s tells RadarOnline. “She has never been allowed to though, she always gets a lucky break and she hasn’t learned that there can be serious consequences to her actions.

“Brooke knew that if she used drugs she could lose custody of the boys. But, what happened? She used drugs, and didn't lose the kids - so she got away with it.
