Dive Death Dismissal: Honeymoon Murder Case Is Thrown Out By Judge

Posted on Feb 23, 2012 @ 05:30PM - 18 comments

By Debbie Emery - Radar Reporter

The capital murder charge against Gabe Watson over the death of his wife after she drowned during a scuba dive on their honeymoon, has been abruptly dismissed.

The judge in the Birmingham, Alabama courtroom ruled on Thursday that prosecutors failed to present enough evidence of a crime to send the case to jurors, and ended the two week trial by dismissing the case personally.

"The evidence is sorely lacking that it was an intentional act," said Judge Jimmy Nail, reported AL.com, in response to a defense motion for acquittal after the prosecution completed its case. "The only way to convict him of intentional murder is to speculate. Nobody knows exactly what happened in the water. I'm sure we'll never know."

By Debbie Emery - Radar Reporter

The judge in the honeymoon murder trial of Gabe Watson is set to make a critical ruling as to whether jurors will see a dramatic reenactment by Australian police portraying the drowning death of wife, Tina Thomas Watson.

In a special President’s Day court session on Monday, Judge Tommy Nail indicated that he would not allow the testimony but agreed to deliberate overnight and make a formal decision on Tuesday after former Queensland Police scuba diver Joshua Kinghorn was flown all the way around the world to Birmingham, Alabama, to describe the death plunge recreation on the wreck of Townsville's SS Yongala, which cost police many thousands of dollars, reported the Courier Mail.

Trial Begins For Man Accused Of Drowning His Wife During Honeymoon Dive

An Alabama man is facing capital murder charges after his wife of just 11 days drowned during a honeymoon scuba diving trip in Australia.

It’s taken eight years for Gabe Watson, of Hoover, Alabama, to be brought to justice in the U.S. after he allegedly turned off the air supply of new wife, Tina Thomas Watson, 26, while the couple were on an underwater adventure at the Great Barrier Reef in 2003, in the hope of gaining her life insurance policy.

Watson, 34, has already served 18 months Down Under after pleading guilty to manslaughter there in 2009, reported AL.com.  The surprisingly short sentence he received sparked outrage among Tina’s family, who joined forces with prosecutors in the attorney-general’s office to obtain a two-count capital murder indictment against Watson in his home state just before he was freed from prison.

Debbie Hanson was born with a congenital condition where the top of her jaw and eyebrows had not formed properly in the womb. She is blind in her left eye and severely short-sighted in the right.

Growing-up she was concerned that she would never be in a romantic relationship because of how she looked but conversations over the phone with a work associate blossomed and led to her finding her soul mate.

Debbie worked at her local job center when she was 18 and would sometimes speak to a man that worked in the council's housing department. Her chats with Lee Hanson, started out purely about work but would soon lead to them laughing and flirting on the line.

The brunette was happy to eventually meet face-to-face when Lee invited her out on a date but she felt the need to forewarn him about her disfigurement.

"I've had surgery on my face. I don't look like everyone else," she told Lee. But he was not put off and his response was: "So what?"

Lee had splashed out on a new Chanel aftershave especially for their first date but was not aware that Debbie did not have any sense of smell.

The pair soon fell in love and after three weeks he told her that he thought they should get married. They tied the knot in May 1989.

They've raised two children together; Becky, 18, and Josh, 14, and Debbie is happy that she took a chance on love and did not let her disability stand in her way.

But life has not always been easy for Debbie who was mercilessly teased at school while growing up in Birmingham, England. "Hey, Miss Piggy, did your face melt in a fire?" a boy shouted at her once, she recalls.

She endured a 12-hour operation and three months in hospital soon after she started high school where doctors tried to mould a nose for her through a bone graft.

Debbie is now an advocate for other people with disfigurements and says she has proved people wrong who said she would never make anything of her life.
