EXCLUSIVE: Jersey Shore's Pauly D Sued For Bar Brawl - Source Claims Lawsuit Is "Totally Frivolous"

RadarOnline.com has learned that Jersey Shore star, Pauly D, is being sued by 21-year-old hairdresser, Kenneth Hoffman, following an altercation at the Bamboo Lounge in New Jersey on July 1st 2009.

In a lawsuit filed late last month, Hoffman's attorneys, Jean Donoghue-Simon and John Novak state that Pauly D punched their client in the face, going on to claim that Hoffman was "savagely beaten."

A source close to Pauly tells a very different story though, claiming it's a completely frivolous lawsuit.

The source also claims the altercation was actually started by Hoffman - saying he pushed aggressively into Pauly D's Jersey Shore co-star, Vinny, prompting Pauly to lash out in protection of his buddy.

"There's no merit to this lawsuit at all," the source tells RadarOnline.com exclusively. "I feel badly for Pauly, as this went down it was just a reaction punch."

Hoffman though says he suffered a severe injury to his cervical spine for which he later required spinal-fusion surgery.

He also claims he was out of work for about eight weeks and currently has been able to return to work only on a limited basis.

The lawsuit, filed in Superior Court in Ocean County, names MTV, its parent company, Viacom International, Jersey Shore and its producers 495 Productions, Pauly D, Bamboo Bar, and Bamboo Bar bouncer Thomas McDade as defendants.

A judge has ruled that the lawsuit regarding bar brawls in which MTV Jersey Shore star Ronnie Magro participated in can move forward, RadarOnline.com has learned.

An attorney for the three plaintiffs had filed a racketeering lawsuit against MTV and the 495 Production Company, claiming the reality show was profiting from the bar fights the plaintiffs were involved in by showing footage of them on air (the plaintiffs were blurred out).

"This is a tremendously significant thing. An open acknowledgment on the record by the court that the racketeering count can now go forward. This could wind up being a $5 million punch," attorney Eugene LaVergne told RadarOnline.com exclusively.

Magro, who also goes by the name Ronnie Oritz-Magro, allegedly followed plaintiffs Josh Thomas and Kristin Perrenod out of a New Jersey bar on August 23, 2009, with the intention of causing a confrontation. Thomas and Magro eventually started to physically fight after exchanging insults.

The original documents claimed no one broke up the fight until an MTV security guard intervened and “detained J.T. until such time as police arrived, all while defendant Ortiz was allowed to quickly flee the scene with [girlfriend and Shore co-star] Sammi Sweetheart to avoid arrest.”

The third plaintiff Stephen Izzo was punched by Ronnie in a separate incident which aired during another episode.
