Chief Deputy District Attorney Arnold Mordkin has told RadarOnline.com that ‘the book is not closed’ on actor Charlie Sheen.

Reports had surfaced that the Pitkin County D.A.’s office in Aspen, Colorado no longer had any interest in investigating any probation violation surrounding the star who went on a wild cocaine and booze bender at The Plaza Hotel in New York early Tuesday.

Charlie Sheen WON’T get any star treatment if he’s ordered to work with the non profit Theatre Aspen group as part of his prison sentence.

Judge James Boyd is expected to green light the actor to do some public service work with the company as part of his plea deal to his domestic violence case involving estranged wife Brooke Mueller.

And while that may seem cushy, Theatre Aspen’s Artistic Director Paige Price told RadarOnline.com: “Charlie Sheen will be treated like anybody else -- there will definitely be no star treatment.”

The Two And A Half Men star, who earns more than $1 million per episode on the popular sitcom,  will not exactly be suffering, though, from the description RadarOnline.com heard.

“He will have to share an office with the rest of us and the only perk that he will receive is that he will be allowed to smoke,” Price told us.

“We have done these kind of placements with the courts before and we haven’t yet decided how we will utilize Mr Sheen’s talents as we prepare for a busy summer season here in Aspen.

“It could be he gives the actors a master-class or does some voice-over work or maybe a question and answer session.

“Mr Sheen will be supervised at all times and we expect him to take his duties seriously – he is an actor after all, so, hopefully he will get something out of it too.

“Some reports have falsely stated that he will be taking part in rehearsals or coaching individuals on their parts.

“Despite the fact that we are non-profit we have professional actors who are accomplished in their own right, so they are unlikely to be fazed by Charlie Sheen or his fame.

“I don’t want to comment on the charges that may send him to us but I’m sure a lot of people within our group are excited with the prospect of working with him.

“His input will be geared to helping the Aspen Theatre actors or students and hopefully he will do that to the best of his ability.”

The summer slate for Theatre Aspen, located just a short walk from Pitkin County Jail off of the Rio Grande Trail near the Roaring Fork River, includes such performances as “defying gravity: Theatre Aspen Takes on Broadway's Biggest Hits,” “The Marvelous Wonderettes,” and “The True Story of the 3 Little Pigs!”

Two of its summer camps, Sharpen Your Skills (June 7-24) and Fun in the Theatre (June 14-24), will be held while Sheen serves his time here, should Judge James Boyd approve the plea agreement.

Assistant Deputy District Attorney Arnold Mordkin confirmed that Sheen, who recently renegotiated his sitcom contract to approximately $2 million per episode, could leave the jail periodically to work at Theatre Aspen.

“There have been discussions about him doing useful public service working in an educational capacity with Theatre Aspen,” he said. He declined to elaborate.

Sheen is expected to plead guilty to third-degree assault a misdemeanor. In exchange, the prosecution would drop the most significant charge, felony menacing, along with the misdemeanor count of criminal mischief.

Sheen was arrested Christmas Day after he allegedly threatened his wife, Brooke, with a knife at the West End home where she was staying.

Charlie Sheen will fight for his freedom beginning Monday when he faces three domestic violence charges stemming from an incident with Brooke Mueller and RadarOnline.com has learned that his defense will attack the credibility of the police officer who interviewed Mueller at the scene.

RadarOnline.com has also learned that there are no independent witnesses to whatever happened between Brooke and Charlie, complicating the prosecution’s efforts to convict the Two and a Half Men star.

A source close to the situation told RadarOnline.com that Assistant District Attorney Arnold Mordkin and his team will heavily rely on Mueller’s emotional 911 call where she claimed Sheen had a knife, threatened her and that she was scared for her life.

The Two And A Half Men star’s legal team, meanwhile, will claim that no offense happened and are gearing up to attack the credibility of local Patrol Officer Valerie McFarlane who has just been fired from the Colorado Police Department.

McFarlane was one of two responding officers to the couple's Aspen home after Mueller called 911 on Christmas. 

She was the officer that interviewed Mueller about the incident while the other arresting officer, Rick Magnuson, who interviewed Sheen, also has a murky past. Mueller told McFarlane that Sheen held a knife to her throat and threatened to kill her.

McFarlane was fired from the police department for a series of incidents, which included allegedly attending and gaining free entry to the Jazz Aspen Snowmass Labor Day Festival in her police uniform while off duty; a direct violation of department policy.

She also reportedly gained VIP access and snuck her daughter and her daughter’s boyfriend into the VIP area.

A source told RadarOnline.com: “It’s going to be very interesting because there does not seem to be any plea deal on the horizon and both sides believe they have strong arguments to make.

“Mordkin does not believe that the defense bringing-up McFarlane’s credibility is as strong as Mueller’s actual 911 call.

“It should make for an explosive situation and the stakes have never been higher for Charlie Sheen at this stage in his career.”

Sheen is facing one felony and two misdemeanor charges in connection with the domestic violence incident - since the Christmas arrest he has entered rehab and so has his wife Brooke Mueller.

RadarOnline.com has also learned there are no witnesses to the incident between Charlie and Brooke, a good situation for the defense.

As RadarOnline.com reported earlier, Sheen’s legal team will actually try to discredit his wife’s recollection of events to the police because of her alcohol and drug problems. She had been drinking heavily and doing drugs in the hours before calling 911.

“Charlie is going to contend that everything Brooke told police isn’t true – that she was out of her head, that she was so messed up she didn’t know what was going on,” one source said.

The other thing Sheen has going for him is Mueller does not want to cooperate with prosecutors. And while she has to be careful about backing off her story because she could be prosecuted for making false statements to police, she also does not have to cooperate with prosecutors.

Colorado has cracked down on domestic violence cases and won convictions without the testimony of the beaten spouse but this case is more difficult for prosecutors because Mueller’s heavy drug and alcohol usage at the time of the incident will harm her credibility.

Charlie Sheen will be out of rehab to resume taping his hit show Two and a Half Men on March 19, RadarOnline.com has learned exclusively.

The popular CBS show was suspended after Sheen checked into a rehab on February 24. He had resumed drinking alcohol and was using cocaine.

Sheen’s show will resume taping on March 19. While he is in rehab his wife Brooke Mueller is also being treated for crack addiction and alcoholism. She bolted from two rehabs and is receiving treatment at home.

And if that isn’t enough pressure the actor also has a March 15 date at Pitkin County Court in Colorado in connection with the domestic violence incident that led to his arrest on Christmas.

RadarOnline.com previously revealed how Chief Deputy Attorney Arnold Mordkin will turn down any plea deal that does not involve a felony.

Sheen is facing one felony and two misdemeanor charges regarding the incident when he allegedly held a knife to wife Brooke Mueller’s throat and threatened to kill her.

Colorado authorities want to interview at least three women from Charlie Sheen’s past as they get ready to prosecute the actor on domestic violence charges, RadarOnline.com has learned exclusively.

Ex girlfriends Brittany Ashland and Kelly Preston, plus ex wife Denise Richards are all being sought for interviews, a source close to the situation told RadarOnline.com.

The district attorney handling Sheen’s case has not issued subpoenas and authorities want the women to cooperate voluntarily as they collect information about Sheen’s troubled past.

Sheen and his wife Brooke Mueller are both currently in rehab.

Pitkin County DA Arnold Mordkin refused to comment when asked by RadarOnline.com if he or his office is trying to interview the women.

But a source told RadarOnline.com that at least one of the women has already been contacted with the request. The interview has not yet taken place.

The Two And a Half Men star was charged with a felony misdemeanor charge of menacing and misdemeanor charges of third degree assault and criminal mischief after he was arrested on Christmas when third wife Mueller told police he held a knife to her throat and threatened to kill her. If convicted, Sheen faces years in prison.

Mordkin told Radar Online.com: “I will not confirm or deny these reports and I can’t comment on what we may or may not be considering doing in this case.”

When asked if he would consider requesting a hair sample from Sheen who is currently being treated in rehab for spiraling cocaine and alcohol use Mordkin was also non-committal.

“I really cannot comment on that either because we do not know if those reports are reliable - but we are expecting to see Charlie Sheen back in Court on March 15, 2010.

“We do not expect to see Brooke Mueller unless she is going to make some kind of motion in the case.”

RadarOnline.com was first to report that Sheen has been using cocaine and alcohol during the months leading up to his rehab stay.

Sheen who has been married three times and has five children has a violent history with women.

In 1990 Sheen accidentally shot his fiancée actress Kelly Preston in the arm effectively ending their engagement. In 1997 Sheen pleaded no contest to criminal charges after girlfriend Brittany Ashland accused him of grabbing her by the hair and smashing her face-first into a marble floor. She also claimed that he threatened her to keep quiet about the alleged attack.

Then in 2006 his second wife Denise Richards filed a restraining order against him claiming that her husband threatened to kill her.

While the prosecution in Colorado may not be able to use any of those prior bad acts in Sheen’s current case, the fact that they are gathering that type of detailed information on him shows, according to the source, that behind the scenes they are not leaning toward leniency if Sheen is convicted.

The Colorado District Attorney in the Charlie Sheen assault case says he is unlikely to subpoena the actor’s medical records from rehab to see if he violated a no-alcohol order, RadarOnline.com is reporting exclusively.

Now that the Two And A Half Men star has checked himself into rehab, Pitkin County Chief District Attorney Arnold Mordkin is monitoring developments and could jail Sheen if he discovers that the actor has been boozing and breaching his bail bond agreement with the courts following his alleged Christmas Day assault on his wife Brooke Mueller.

Sheen Announces He’s Going Into Rehab

Sheen announced Tuesday through his representative that he is going into rehab as a “preventative measure.”

Mordkin could attempt to subpoena Sheen’s rehab records to see if the actor has been using drugs or alcohol but told RadarOnline.com: “I do not expect that I will do that - but we will have to wait and see.

Charlie Sheen had been hoping he could get away with not having to appear in person for his January 20th court appearance in Aspen Colorado to request modification of his restraining order protecting his wife Brooke Mueller - opting instead to make himself available via telephone. But not so. RadarOnline.com has learned that Sheen will have to in fact appear in person for that hearing, and also for a subsequent court hearing scheduled for February 8th.

Pitkin County Chief Deputy District Attorney Arnold Mordkin told RadarOnline.com “Carlos Esteves [Charlie Sheen] must appear in person on January 20, 2010 at 9 am for the motion to modify the mandatory protection order.”

The restraining order was put in effect following Sheen’s Christmas day altercation with Mueller. Shortly after the altercation Mueller told police that were called to the scene that Charlie had threatened her with a knife and that she “feared for her life”.

As RadarOnline.com previously reported Mueller is now in favor of lifting the restraining order and wishes to try to work things out with Charlie, following a $1 million sweetener that Charlie’s camp have offered as an incentive.
