Jared Lee Loughner, the man accused of fatally shooting six people and wounding 13 others, including U.S. Representative Gabrielle Giffords at an Arizona supermarket on January 8, has pleaded not guilty to a new,expanded 49-count indictment, RadarOnline.com has learned.

Loughner appeared in a Tucson courtroom Wednesday wearing a khaki prison uniform, belly chains - his shaved head shown in previous mug shots now shows the growth of dark hair. When asked if his name was Jared Lee Loughner, he answered that it was and his attorney, Judy Clarke, asked the judge to enter the plea to the new indictment on his behalf.

While one mug shot was already released of alleged Arizona shooter Jared Loughner, his attorney’s fought to keep this mug shot from being released, but RadarOnline.com has obtained it.

The newly released mug shots bear a striking resemblance to the previous mug shot, with Loughner’s shaved head and eerie smirk, although the new photos show a prominent laceration on the right side of his head.

The newly released mug shots bear a striking resemblance to the previous mug shot, with Loughner’s shaved head and eerie smirk, although the new photos show a prominent laceration on the right side of his head.

As RadarOnline.com reported, one booking photo of Loughner was previously released to the public by the Pima County Sheriff, but after he was turned over to the United States Marshals, two additional booking photos were taken.

It’s standard practice for the U.S. Marshals Service to refrain from releasing booking photos, but after a case was brought on by the Detroit Free Press vs. Department of Justice citing the Freedom of Information Act, the mug shot was released on Tuesday.

The 22-year-old was arrested in January after opening fire at a Safeway grocery store in Tucson, Arizona – killing six people and injuring 14 others, including Arizona Congresswoman Gabrielle Giffords.

The six people dead in the wake of the desert massacre are U.S. District Judge John Roll, 63; 9-year-old Christina Taylor Green, who was born on 9/11, Giffords' aide Gabe Zimmerman, 30; Dorothy Morris, 76; Dorwin Stoddard, 76; and Phyllis Schneck, 79.

Loughner pleaded not guilty to attempted assassination and murder charges but has yet to be charged by the state of Arizona.

Another legal fight is brewing in the case of alleged Arizona shooter Jared Lee Loughner who is accused of killing six people and the attempted assignation of Congresswoman Gabrielle Giffords and it’s all over the release of his Federal mug shots, RadarOnline.com has exclusively learned.

Another legal fight is brewing in the case of alleged Arizona shooter Jared Lee Loughner who is accused of killing six people and the attempted assignation of Congresswoman Gabrielle Giffords and it’s all over the release of his Federal mug shots, RadarOnline.com has exclusively learned.

In court documents filed with the United States District Court, District of Arizona, the U.S. Attorney's Office, as well as Loughner's attorney Judy Clarke oppose the release of Loughner’s Federal mug shots despite over one dozen requests by the media to do so citing the Freedom of Information Act (FOIA).

In January, the Pima County Sheriff's Department released one booking photo of Loughner to the public, taken while he was in their custody – depicting Loughner with a shaved head and an eerie grin on his face.

But Loughner was later turned over to the United States Marshals, where two additional booking photos were taken of him – one profile shot and one front shot.

According to court documents, these photos “show Mr. Loughner in sharper resolution with abrasions on his face, and in prison garb, with a cinder block wall in the background.”

Officially, it is standard practice for the U.S. Marshals Service to refrain from releasing booking photos, but because of a legal loophole, they are seeking a judge's order prohibiting those photos from being made public.

But thanks to a previous ruling by the U.S. Court of Appeals for the 6th Circuit in a case brought by the Detroit Free Press vs. Department of Justice –  the ruling in that case may provide the loophole they need. The court ruled mug shots had to be released when there is no privacy interest at stake.

Currently, there are 15 media outlets requesting the mug shots - four of those outlets fall within the 6th Circuit's jurisdiction, making the release of those mug shots a possibility.

Despite the ongoing hurdles surrounding this case, the United States Attorney's Office and Judy Clarke, Loughner’s attorney, agree on one thing – they don't want the mug shots released to the public and they want them to remain under seal.

In a motion objecting a release of the mug shot, Loughner’s attorney states, "first, a mug shot is associated with guilt, an association which prevails regardless of the outcome of the case....Second, a mug shot is humiliating. It captures an individual usually unflattering expression at a humiliating moment. Third, a mug shot has a long-term stigmatizing effect. The effect remains even after a sentence has been served."

Loughner's attorney goes on to say that releasing the mug shot could prevent her client from getting a fair trial and could garner more media attention.

A hearing is scheduled on February 18th to determine if the mug shot should be released.

In addition, according to the police reports, Loughner was the victim of bullying on two occasions – once when he was assaulted with a sharp needle and once when he claims an ex-friend posted a mock profile of him on the internet.

Loughner’s first arrest occurred May 23, 2006 after his Mountain View High School principal contacted cops at 9am to inform them that Loughner had been taken to the North West Hospital emergency room apparently under the influence.
