Landmark Los Angeles restaurant The Ivy is being sued by a former employee who claims that he was wrongfully fired after being diagnosed with HIV, RadarOnline.com has learned.

The lawsuit against the famous celebrity hang out, which was filed at the California Superior Court in Los Angeles Thursday, states that it violated the Fair Employment and Housing Act (FEHA), and discriminated against former employee Reymundo Martinez by wrongfully terminating him on the basis of his medical condition at the beginning of last year.

President Barack Obama, at a World AIDS Day event in Washington D.C. Thursday, said, "We can beat this disease" with enhanced treatment, awareness and efforts on a global level.

"The rate of new infections may be going down elsewhere, but it's not going down here in America," the president said. "There are communities in this country being devastated still by this disease.

“When new infections among young, black, gay men increase by nearly 50 percent in three years, we need to do more to show them that their lives matter."

Twenty years to the day of his historic announcement he was retiring from basketball after testing positive for the HIV virus, Earvin “Magic” Johnson will announce new initiatives Monday for his foundation, which aims to educate the community on HIV/AIDS prevention.

Two of the biggest companies began shooting again last week and Vivid Entertainment announced it will resume on Monday. All the companies involved have their studios in LA's San Fernando Valley and it is not uncommon for porn stars to work for multiple producers.

The shut down began October 12 after an actor, referred to as Patient Zeta, tested positive for HIV. The situation was called a "time bomb" by former porn superstar Jenna Jameson in an exclusive interview with RadarOnline.com.

"We can now confirm that all performers who were on the quarantine list as a result of being exposed to the HIV positive performer have gone through two rounds of testing and the results are negative," said Vivid co-chairman Steven Hirsch.

But guidelines from the AIDS Healthcare Foundation indicate the porn studios should wait at least another month before putting exposed performers back on the job. "It could be anywhere from 12 weeks to six months that an HIV infection could appear," explained communications director Ged Kenslea.

Lindsay Lohan has presumably turned down the porn role she was offered even though it would have helped may her bill at the Betty Ford Center. She is still scheduled to star as the late porn star Linda Lovelace in a biopic titled Inferno.

“And even if I was HIV positive, which I am not, I would still have rights to see my child - Jesse is just coming up with any excuse that he can to prevent me from spending time with Sunny.”

Both Janine and Jesse are scheduled to return to Orange County Family Court on October 24 with Lindemulder requesting a '730' evaluation plus a modification in visitation and counseling for herself, Sunny and Jesse James.

In July, Commissioner Thomas Schulte ruled that both parents would have joint legal custody of Sunny, but that it was in the child’s best interest for her to live in with her dad in Austin, Texas.

Lindemulder has also denied recent reports that she has reached-out to James’ ex-wife Sandra Bullock to help her in her custody fight over Sunny.
